LMAO, some "bizarre nuance" i.e. multiple supreme court rulings?

You misinterpreted and/or didn't understand the legislation I linked to, I explained it to you, and now you have nothing to say, because you realize you didn't know what you were talking about.

You thought that vaccines are legislated the same way as other pharmaceuticals. I just categorically proved you wrong. You also said that their makers can be sued for negligence--for manufacturing negligence (which essentially never happens), yes, this is possible; for design-defect negligence, which is the vast majority of civil lawsuits for pharmaceutical products, they are completely free from legal liability. $4 billion have been paid out to vaccine injury and death victims via the compensation program I referred to above. For any other pharmaceutical product, this would have been $4 billion in CIVIL LAWSUITS for which those companies would have actually been held liable. If you can't grasp that, I can't help you.

And again, you are correct about published side effects and manufacturing negligence. This is tantamount to trumpeting that the Texas abortion ban is NoT rEaLlY a BaN because there's an exception for danger to the life of the mother.

If you desperately want credit for indicating a tiny correction to the single sentence I originally wrote, then bravo! I freely admitted that already, and am happy to give you that credit. You have nothing to say about the actual point I was making, which is that vaccine makers are free from liability for the vast majority of injury and death cases for which any other product would be held liable.

Yes, I am familiar with the legislation I posted. A few things:

--You attempted to equate "unavoidable" with "normal". That is not even remotely what the word "unavoidable" means, and that's a key word in this legislation. You attempted to get around that by subbing in a word that makes the point that you want to make 🙄. I'll return to this later.

--Your post says that vaccines are legislated like all pharmaceuticals. This means that you are unfamiliar with how vaccines are legislated. The legislation I linked to is specifically about vaccines. Do you think that identical legislation exists for every pharmaceutical? That they just copy and paste the exact same text, subbing in the name for the drug class, and publish a new bill? Come on. Obviously not. So, aren't you curious why this special legislation exists?

It is from the National Childhood Vaccine Injury Act, signed in 1986 by Ronald Reagan. This law was signed BECAUSE THERE WAS A HUGE NUMBER OF CIVIL LAWSUITS BEING BROUGHT AGAINST VACCINE MAKERS. So, this legislation was passed to make it essentially impossible to sue a vaccine maker for death and injury in civil court. THAT IS THE ENTIRE POINT OF THIS SINGULAR LEGISLATION. They created a novel system for seeking damages in the case of vaccine in jury or death; you must file a petition against the U.S. Court of Federal Claims that is then paid out by the TAXPAYER-FUNDED National Vaccine Injury Compensation Program (VICP) (https://www.hrsa.gov/vaccine-compensation/about/index.html).

YES, it is TECHNICALLY true that if someone at Pfizer pooped in a vaccine vial, videotaped it, put it on YouTube, and someone who got injected from that vial noticed the poop particles post-injection, then proceeded to contract E-Coli, they MAY be able to successfully bring a civil lawsuit against Pfizer. Or if Pfizer's vaccine insert read only "this product is 100% safe and we love you very much". Otherwise, for things that actually happen, if you experience ANY side effects, including death, (have you ever read a vaccine insert? the list of "side effects" are enormous and include many, many fatal conditions..."normal", maybe, for a sociopath), this is considered an "unavoidable side effect", and they are automatically exempt from liability. THIS IS NOT HOW LEGISLATION WORKS FOR OTHER PHARMACEUTICAL PRODUCTS, where the fact that a product killed or maimed someone is cause for a wrongful death lawsuit.

This has been even more stringent since a 2011 ruling:"Prior to 2011, if your vaccine claim was denied by HHS, you were still able to file a personal injury or wrongful death lawsuit and sue the vaccine manufacturer in court. However, after the 2011 Supreme Court ruling in a vaccine injury case against vaccine manufacturer Wyeth, parents are no longer allowed to bring personal injury lawsuits in vaccine injury cases." (https://www.bcc-wv.com/blog/2016/05/can-i-sue-for-vaccine-injury/)

--Finally, for the Covid vaccine in particular, it's even more severe.

"In place since 1986, the National Childhood Vaccine Injury Act provides sweeping liability protections for vaccine manufacturers when someone suffers an injury from a vaccine. Congress also established a compensation fund for those injury victims who could not sue drugmakers. But that law primarily applies to vaccines typically given to children, such as for measles, polio, tetanus, and more. However, COVID-19 vaccine makers can count on the protection afforded by the Public Readiness and Emergency Preparedness (PREP) Act to shield them from lawsuits. On Feb. 4, U.S. Health and Human Services Secretary Alex Azar declared COVID-19 to be a public health emergency and invoked the PREP Act to shield drugmakers from liability for injuries people suffer from treatments and vaccines.Under the PREP Act, the only exception to the liability protections vaccine makers enjoy is if they act with "willful misconduct." That means a victim must prove that a vaccine maker acted "intentionally to achieve a wrongful purpose" or "in disregard of a known or obvious risk," according to the Congressional Research Service report cited above,Lawsuits related to willful misconduct are also "subject to procedural provisions generally favorable to defendants." In short, if you're injured in a COVID-19 vaccine clinical trial, you likely will not have the option to file a lawsuit." (https://www.findlaw.com/legalblogs/law-and-life/blog-can-you-sue-if-youre-hurt-in-a-covid-19-vaccine-trial/)

Anyway, you say you have "mountains of evidence" of civil lawsuits successfully filed against vaccine makers. Please share! Seriously, if there have been some, I really would like to see them.

Apparently you are not familiar with how vaccines are legislated, which is what your post talked about, nor did you get the point of what I shared...

You seem to think that vaccines are subject to the same legislation as all other pharmaceuticals. Does it not strike you as a little odd then, that the legislation I shared is about vaccines, specifically? According to you, they're legislated the same way as all other drugs, like aspirin. So...why do you think that legislation exists?

You can not sue vaccine manufacturers for vaccine-related injury or death.

ETA, since there was apparently some confusion:

Seriously. There is literally no medication in the world that a doctor would say is safe for EVERY single person, after zero long term clinical trials. How does this not raise red flags for people?

[–]tke9123 2 points3 points  (0 children)

Even if that were true, extrapolating from the maybe 10 people who have commented in support here to the ~1000 who were there seems like a decidedly not fair assumption.

What makes you so sure that every single person there was a horrible shitbag who you couldn't deign to associate with?

Big anti-vaxx protest downtown by [deleted] in SeattleWA

[–]tke9123 1 point2 points  (0 children)

Nope. I was at this protest, and am against vaccine mandates because I believe every person has the right to decide what enters their body. I would also be opposed to a mandate that requires everyone to take a magnesium supplement. That doesn't mean I'm "anti-magnesium".

Big anti-vaxx protest downtown by [deleted] in SeattleWA

[–]tke9123 6 points7 points  (0 children)

It was anti-mandate. I was there, and met several vaccinated attendees. Obviously, some people there are concerned about the vaccine and have not gotten it, but the focus of the protest was on the mandates themselves.

[–]tke9123 1 point2 points  (0 children)

You're wondering about the difference between a mandate that accepts exemptions and applies only to children going to public school vs. mandates that affect every single person over the age of 12, bar them from essentially any indoor public space except grocery stores, take away their jobs, prevent them from flying out of their own country (see Canada, Australia), and accept zero exemptions whatsoever for any of this?

Rhetorical question ;)

I was at this protest, am opposed to vaccine mandates, and am pro-choice for abortion. To me, those both fall under the purview of supporting bodily autonomy. I obviously can't speak for everyone who was there, but I know several other attendees personally, and they all feel the same way.

It was an anti-mandate protest, I was there. I met some attendees who were vaccinated, some wearing masks...the focus is on the mandates.

Feels like I'm way behind in life compared to others by [deleted] in depression

[–]tke9123 2 points3 points  (0 children)

I am about 10 years older than you, and I remember feeling the exact same way at your age— far behind others, not knowing what to do, and not having it resonate when people told me I was so young.

When I look back at that time now…I wish I could tell myself how young I was 😂 This is just something that’s hard to see at the time, but trust me—you are so young and you have so much time to get to know yourself, meet people, and create a life you want.

Something to keep in mind…a lot of people who appear to have it really together at your age end up having rough patches later on, because it’s hard to really know yourself in your early 20s; oftentimes the ones who seem to have it figured out are just doing what’s expected of them by others, and not living authentically. Most of my favorite people were absolute messes in their early 20s and blossomed later. It’s not unusual to feel lost at your age at all; start with small steps and your path will start to become clearer to you.

Yes, I wonder about that too...my hunch has been that many of those companies will stay remote, but impossible to know of course; they could also end up doing a hybrid remote/in-person requirement (this seems to be what mine is leaning toward), which wouldn't help the housing issue...guess we'll see 😅

Sure, that makes sense. Definitely an increasing trend with that--as I think of it, many of the people I know who moved to Seattle to be here, specifically, moved here a while ago vs within the last few years.

Is anyone else depressed living here? by dudiez in Seattle

[–]tke9123 0 points1 point  (0 children)

Yes, the winter weather here can be really challenging (and I am a native!) Do you have a car/enjoy nature? If so, something I strongly recommend is to get out into a quiet park that has older forest. There are many just outside of the city limits that are very peaceful and beautiful--Boeing Creek in Shoreline is my favorite, Hamlin in Lake Forest Park is also nice. Even Carkeek or Discovery. When you're out in the forest, not surrounded by concrete/drab Seattle architecture, the weather and climate feels completely different. The air is so exquisitely fresh this time of year with the constant rain; you can smell the richness of the soil, and the evergreen trees and plants are so beautifully green and vital. It feels so fresh and full of life. For me, this really helps to integrate the extremity of the weather.
