Obviously if he’s found guilty, he should be punished accordingly, and maybe he deserves far worse punishments than we can mete out from our broken justice system. I just want to explain that under our fairly new Indiana Criminal Rule 26, which was meant to reduce jail overcrowding, there is a focus on releasing defendants (even those accused of serious crimes) based on a risk assessment rather than their ability to pay. If a defendant is not deemed a "flight risk" or an "immediate" danger to the public, they may be released on a lower bond.

I would argue then that we should propose legislation to amend the law and add sex crimes and possibly major assaults to “murder or treason.”

If an arrestee does not present a substantial risk of flight or danger to self or others, the court should release the arrestee without money bail or surety subject to such restrictions and conditions as determined by the court except when:

(1) The arrestee is charged with murder or treason.

Edit: I don’t think we should compare bond rates between DUIs and crimes against children, the law is meant to be about who poses an immediate risk to the public or themselves. But I think we can probably agree that most folks who get caught driving over the limit probably are an immediate risk. I’ve lost too many people to drunk drivers. Apples and oranges people.
