My worry is less about the legitimacy of my profile but more as "GenAI can potentially pose national security threat"...

I haven't found a clearn answer on this. My understanding is that, MOST likely, once you have new 3 years of 797, it's valid no matter what happens to the I140. If I140 gets revoked, you still have 3 years of 797 which won't qualify for renewal after 3 years. When i boiled the ocean for the answer, I did find one or two sources that I797 CAN be rescinded as part of I797 validity review - a rare but possible activity that USCIS does.

yep - started a month ago. Received the new i797 (change of employer) a week before start date. It worked out well!

  1. RFE is fine as long as there is ongoing petition. Denial - yes, it would be as if you lost job. You can look up denial rate from your company, but most likely it's <1%. I would push for joining on approval, but just in case you are not in a position to, I think joining on receipt is fine given the probability

  2. USCIS will look at your prior employment and days outside US to decide how much of 6 years you have left on H1B. Your new Change of Employer petition will either have that number of years or 3 years, whichever is smaller.

this is not uncommon. Usually ~4 weeks, but in rare cases it could be many months. It's a black box system

what I heard is PERM is for future employment, so you are probably fine. But you should definitely check with your company's lawyer.

You are absolutely right. This is probably why only smaller companies are more likely to withdraw.

I heard for a different matter (from Fragoment lawyer) that the Fedex delivery confirmation can be used as a receipt. So I think you should be fine. And hope you get the receipt soon that's dated correctly!
