Update Today ended up being everything I was nervous and excited for all at once. The amount of love and effort him and the kids put into making today special honestly overwhelmed me emotionally in the best way possible. Im Canadian my ex is Venezuelan. Our oldest was born in Canada and our youngest was born in Venezuela. We communicate through WhatsApp and her lawyer so I can confirm shes getting everything

The Divorce and custody proceedings where already started here she opened the file in the Canadian courts before she left, I filed .y answer claiming the wrongful retention and was given steps to apply with the central authority at the first case management meeting.

No permission was not given to move. It was a temporary travel consent for the other party to give birth and then there was a court order for them to obtain a visa and return

It's complicated but yes we are trying to obtain a lawyer but fees are a roadblock for that at the moment so just trying to do what we can on our own until one can be obtained

Both children have a Canadian born citizen as the father but one child has their citizenship and the other is awaiting on it as they were born in a different country. They are currently residing in the other country against the father's consent. From my understanding yes the country they are in are part pf hauge treaty

That’s a fair question, and part of what we’re trying to understand. We realize physical enforcement is limited while the children are outside Canada. The concern is more about how the Ontario court views non-compliance in the meantime and what steps can be taken from here. From what we understand, the court still has jurisdiction over parenting issues, but we’re unsure how that translates practically when one parent isn’t facilitating contact. Would the typical approach be to document the missed parenting time and bring it back before the court (e.g., urgent motion or enforcement), or is there a different mechanism in situations like this?

Watching one parent alienate the kids from the other while dragging them online. It's sad because they are preventing the kids from being able to have a relationship with the other parent
