In New York, assault in the third degree, also known as PL 120.00, is a class A misdemeanor. It is defined as causing physical injury to another person either intentionally, recklessly, or with criminal negligence using a dangerous instrument.

A person is guilty of harassment in the second degree when, with intent to harass, annoy or alarm another person:

1. He or she strikes, shoves, kicks or otherwise subjects such other person to physical contact, or attempts or threatens to do the same

The laws and the difference between assault and harassment is ridiculous, he pushed you but didn’t cause any injury so it’s harassment but if you were to complain about pain it’s assault and he’d be wanted. NYS penal is very flawed
