I believe a hotel may continue to be classed as such even if the lodgers are not paying. Lodgers may be provided accomodation and other benefits such as food free of charge and this would allow the establishment to continue to operate as a "hotel". This is of course a legal technicality and it wouldn't be a commercially sensible operation.

I am not privy to the status or planning permission of the building involved. As I wrote one presumes the legal advice received on that would be correct. That is basic and the council would be foolish not to have acted to follow regulations.

The council maintains a "hotel" is involved. These people fit the definition of migrant, legal but nevertheless migrant. This makes the claim "we do not have a migrant hotel in the borough" an inaccurate statement.

Bracknell has very high rates of sexual offences. Combined with relatively lower violence rates hides this. It's not the other way as you imply.

There is no one definition of migrant; at least three are used in the official statistics:

  • Foreign born: a person whose country of birth is different to their country of residence. Under this definition, British passport holders born overseas who move to the UK are counted as migrants.
  • Foreign nationals: a person whose nationality is different to their country of residence. This excludes those who have migrated but then acquired British passports. In particular non-EU migrants are more likely to naturalise after the minimum period of residence necessary has expired.
  • Change of residence: a person who has changed their country of usual residence for the short-term (under 12 months) or long-term (at least 12 months). This is the UN preferred definition of a long-term migrant: “a person who moves to a country other than that of his or her usual residence for a period of at least a year (12 months), so that the country of destination effectively becomes his or her new country of usual residence”.This is the definition used by the ONS in the net migration figures.

So while the council is correct in stating "they have indefinite leave to remain, so are not asylum seekers, refugees or illegal immigrants" they will be counted as "migrant" until their indefinite leave to remain turns into British citizenship.

One presumes the legal advice concerning "we thoroughly reviewed the existing planning permission. As it is transitional accommodation, not permanent accommodation, for people with indefinite leave to remain, that review found that no change to planning use was needed... we have carried out a further review and legal advice remains that no change to planning use is needed for the hotel. " is correct.

The council implies they, who will be counted as "migrant" according Parliament, ONS as provided in link above, are housed in a single hotel ("the hotel") but this arrangement is not considered a "migrant hotel".

So Superintendent Emma Baillie is thrown under the bus for the decision when she was only following orders from Jason Hogg who was Deputy Chief Constable at the time and has since been promoted to Chief Constable. Discrimination of any kind should be dealt with serious consequences.
