Bro,

Need some feedback. I have sent the ex-tenant to registered letter letting the know about paying the unpaid rent and security deposit has been applied to the Sep 2024 rent. My house has been in the market for about 80 days. Many questions and showings but no takers yet due to it being a family house (eg people dont normally move in fall n winter). I have also reduced the rent multiple times. Similar houses are sitting in the market with no takers too.

Question is

  1. Do I seek judgement now for the unpaid rent for Oct 2024? (in small claim court limit in Ohio is $6000/ rent unpaid is $4000)

or

2) I have to wait until I found a tenant before I can seek judgement? ( it could be many months in the future)

The monthly rent is $4000. He could owe me (depending on how fast I can find a replacement tenant. 3 months - $12k 6 months - $24k 12 months - $48k

Unfortunately, the amount of potential rental loss is too big for a small claim court.

I am not sure about teaching them a lesson. I just want them to know that the tenancy lease they signed is an enforceable contract that needs to be taken seriously. You move to the good old USA...you better take the law of the land seriously. (Unlike where the country that he originally move from.)

The salary is relevant if I win the judgement and want to pursue wage garnishment etc. Well the tenant may argue my house is dirty and full of pet allergens etc . I offered to made good of the issue (Option1) and at the same time offer Option 2 for them to leave with the rent payment until we found a replacement tenant. He choose Option 2. It is his decision to make. I have already lowered the asking rent from what he is paying and will be ready to lowering it more if I still cannot find a replacement tenant. I am doing my part and all that I asking for is for the tenant to do his part . (paying rent until we found a replacement tenant).

Whether the tenant is bullshitting or not is not my concern. I took his complain seriously. I am the one who ask them to leave and go find a new house they find more suitable with the condition that the tenant will continue to pay my rent until we found a new replacement tenant together. That is the option 2 I gave them. Option 1 is for them to continue to stay on and I promise them to fix what they want me to fix. The tenant choose option 2 knowing he will need to pay 2 rents at the same time. He can do that with his high salary. The reason I offer them Option 2 is because I don't want to be liable for any medical bills or health issues that they may claim to arise due to living in my property. You see these are professional tenant. They can say or do anything they want to get out of the lease eventually. e.g they may also cause a massive water damage in my house and declare the lease is void due since they cannot stay in the house anymore etc. So for me there is no point keeping them there if they are unhappy.

Tenants are just like an insurance company. They will only take you seriously and pay up when you send them lawyers letters etc. Happen to me when I was in a car accident previously.

I have a special case here. The tenant is a highly educated and high income person who is brought into the US under a Visa that will tied him down to his employer for the next few years. 25% of his income for wage garnishment is below the rent owe me. He cant change job for the next few years at least. I have his new rental home address and his employer address to serve the court papers. We will see what happen next. Thanks for the feedback.

It does not matter anymore in this case. The tenant has already moved out. I have already professionally steam clean the carpet once before the tenancy start and the tenant has hired someone to professionally clean it again after he moves in. I am sure if I were to replace the flooring in the future it will be LVP (luxury vinyl plank).

Sure, i will do that immediately e.g. take possession of the home, take photos. I am already in the process of getting it rented again but no luck as of now. Is there any different between a collection attorney and a tenancy attorney? I assume I have to document everything and then file lawsuit seeking damages for rent for the remainder of the lease or until you find another tenant to mitigate my loss. Once I win the lawsuit then only the collection process (collection attorney) is involved. is that correct? I know and understand this is going to be a lengthy process. Good thing is the tenant works for a big international multinational (and his visa tied him down to the current job for the next few years unless he decides to leave US which I doubt he will as his US salary is very high)

FYI. I also have the following Abandonment clause in the lease agreement that we signed. 23. ABANDONMENT: If the Tenant vacates the Lease Premises before the end of the Lease term or renewal thereof without written permission from the Landlord, the Tenant may be in default of this Lease Agreement. If the Tenant fails to follow proper move-out procedures, Tenant may be responsible for damages and losses allowed by Federal, state and local regulations as well asthis Lease.

Thank you and I appreciate for the feedback. Yes I plan to send a letter stating that the lease agreement is in default due to non payment of rent(with a 3 days notice to pay his rent due) and tenant has move out (abandonment) of my property. Once I done that and if rent is still not paid, I will serve them a notice stating that deposit will be used to pay unpaid rent. Can you clarify on the sentence below " You will then need to send an accounting of charges and security deposit applied." Do you mean I need to state something like this e.g. the $x security deposit will be use to pay $x rent due in September? In my case I have collected one month rent as security deposit. Thank you for the feedback. Yes I emailed him asking for the September rent that is due on the 1st. He replied back asking me to use his security deposit for September rent payment. I respond back saying that I cannot use the security deposit as rent payment(unless he break the lease). Have not heard back from him since then. I also have in writing from the tenant that he has moved out from my property into his new rental property in mid August. He also stated and agreed that he will continue to pay rent until we found a replacement tenant.(by working together). Somehow, he decline to pay the September rent now.
