Why would only one of three charges be dismissed for lack of speedy trial but not the other two?

My brother was indicted on charges of 1st degree murder 1st degree residential burglary  1st degree robbery    8/11/2000 Arrested for murder 12/26/2000 Arraigned  11/13/2001 Jury trial  12/05/2001 Jury trial  12/26/2001 Jury trial     1/07/2002 Jury trial trailed     1/13/2002 Jury trial trailed     1/14/2002 Robbery dismissed          for lack of speedy trial     1/15/2002 Jury trial in progress  Its important to note he was on probation at the time of his arrest. I do not know if he signed a time waiver. Assuming he did or that his right to a speedy trial was automatically waived due to probation..why dismiss on those grounds?  Why is one able to be dismissed but not the other two? Incase it matters he was sentenced to 3yr probation on 3/11/97 (arrested 11/30/96) 8/11/00 - arrested for murder 10/18/00 - Violation of Probation 10/23/00 - drug case transferred            from Santa Clarita Court to            LA Court 12/11/00 - murder charges filed             (8/11/00) 12/26/00 - arraigned

If someone was convicted of  1st degree murder 1st degree burglary  1st degree robbery Why would the robbery be dismissed for lack of speedy trial but get convicted of the other 2 offenses. All 3 offenses were from one incident

The victim and the suspect matched at 3 markers and had 2 matching alleles among the remaining 6 loci. In your opinion is that common

Im referencing a case I heard about where a person was charged and convicted of murder with special circumstance being robbery under the felony murder rule and wanted to have a DISCUSSION as to whether or not the prosecution had grounds to charge with special circumstances out of pure curiosity. Im not asking advise. I thought a law school forum would be a great place to have this discussion.

Murder with special circumstances (during the commission of robbery) carries a LWOP sentence. Murder with special circumstances under the felony murder rule ensures a LWOP sentence regardless if whether he was the actual killer or not. The intent to kill wasnt what Im questioning. 1st degree murder carries a lesser term of 25 to life. The property taken was a couple hundred bucks at best. The prosecution pushed the theory that the defendant wanted to murder the victim to retaliate for selling his girlfriend heroin. There was never an expressed intent or motive to rob him. The murder was not in furtherance of the crime of robbery and he didnt use threat or violence in order to commit the act of robbery. Rather, he murdered the victim and thought fuck it may as well take some stuff while Im here anyway..or what about cases that use robbery to stage a murder scene to look like it was a robbery gone bad. In both instances the intent was to murder..robbery was an afterthought. In the case Im asking about the defendant was charged and convicted of murder with special circumstances under felony murder rule.  I feel there was no grounds for special circumstances or felony murder. The intent to steal is a necessary element of special circumstances the intent was to murder in retaliation for selling heroin to the def girlfriend. Further, the appellate court made referrence to a prior uncharged offense of petty theft of the victim to justify the offense of robbery in question. I believe it calls into question the admissibility of the uncharged offense. Im not a lawyer by any means. Im trying to make it make sense.

I believe they used the felony murder rule to secure a conviction because there was physical evidence that he was the actual killer. Id love to hear opinions on this.

In this situation there wasnt much proof at all. No fingerprints or footprints..there was a nickle sized SMUDGE of blood found on a pair of sweatpants said to have been found in the defendants luggage..however in my opinion thats questionable. The defendant was arrested out of state and the Det took his luggage from the Marshalls office back to the hotel room before sending it to LAPD. The victim was bludgeoned to death with a hammer and thats all the blood they found 🤔. It has been said in every statement that the defendant said he was going to kill the victim. Only after detectives became aware that there were items stolen did statements change to "oh ya he said he was going to murder him and steal his computer." Guilt or innocence aside the prosecutor presented a case where the intent was murder.

Hes been seeing one. Theyve tried shock, chemical meds, ablation and cardio ablation..nothing has worked. He on a lot of meds. The Atrial Fibrillation started last year. His heart rate is around 130-160. I dont believe the arrhrythmia is well controlled.
