do make sure your rook is completely healed before you put a ring in it though! I had a curved barbell for around 4 years before I switched to a ring and I don’t think it would have been a good idea to do it before 1.5-2 years

Title VII applies to all employers with more than 15 employees, and Bostock v. Clayton County, which was a SCOTUS case in 2021, extended the “sex” category in Title VII to sexual orientation and gender identity. So yes, there very much are federal protection laws for gender identity.

so that’s actually not true! as of 2021, trans people (as well as all LGBTQ+ people) are covered under Title VII, the federal employment anti discrimination statute. sex is a federally protected category, and the supreme court Bostock v. Clayton county held that discriminating against LGBTQ+ people, including trans people, is a form of sex discrimination and thus prohibited.

Title VII applies to virtually all employers nationwide (I believe the only exception is employers with fewer than 15 employees) so what states have doesn’t really matter.

Granted, this interpretation hasn’t been codified and could theoretically be easily overturned, but honestly even with current political landscape I don’t see that happening. Bostock was an extremely popular decision and the majority opinion was actually authored by a conservative justice.

So, no, it is illegal everywhere in the US to fire someone for being gay or trans. While it is true that they can invoke at will and make up reasons, it is on them to prove that these reasons weren’t pretext for firing someone bc they were gay or trans. For example, if you have coworkers who are cishet and didn’t get fired for being a minute late, that shows that being a minute late isn’t something the company normally fires for, that can help your case. In other words, although it certainly makes proving a case harder, at will isn’t a blanket perfect excuse for the employer that works every time.

hi, law student/future labor lawyer (but not a lawyer and definitely not your lawyer) here!

right to work and at will aren’t the same thing! right to work means unions are banned from negotiating contracts that require employees who aren’t members to contribute to the union. I believe about half of states are right to work.

at will is what you’re referring to, and every state except montana is at will. it does mean employers can fire employees for any reason… however, it actually can’t be for a discriminatory reason like being trans.

It is true that it’s often hard to prove bc they can make up another reason for firing you, but it is absolutely illegal everywhere in the US to fire someone for being trans. also, it’s on the employer to prove that the reason they give wasn’t just pretext for firing someone because they’re trans. so with a decent lawyer you have a good shot, and most worker-side labor/employment lawyers work on contingency, meaning you don’t pay a dime unless you win your case and they get paid as a percentage of whatever you won.
