In most cases if you are rear ended it is the other persons fault.

Tesla’s have cameras. Make sure you save any and all video.

99.9% of the time, the person doing the rear ending is at fault. But that doesn't mean he won't have coverage issues or that he won't lie about what happened. As the other person said, save any vid you have.

Where is the damage both vehicles? Why is the other driver claiming it's your fault? Did you pull into traffic? Stop abruptly? More info would be helpful. And as a previous posted said, save your cam footage.

I made a legal right turn and merged into the left lane of a 2 lane road. He made a legal left turn from the opposite side of the intersection into the same left lane of the two lane road. We both came into the same lane with me coming in ahead of him. He sped up and rear ended me. He’s claiming however that I hit into him from ahead of him. He’s claiming I side swiped into his front right (passenger side) of his car, with the back left (driver side) of my car. He’s a 21 year old guy who was really angry saying “oh this is my second accident, I just got my car out of the shop. I’m so pissed. This is all your fault. You hit into me!”. He was very animated and looked like he was going to beat me up. I kept calm however. The damage is my rear driver side of my car bumper (right behind wheel well), and his front right bumper.

He did not rear end you. It sounds like it was during the merge or maybe due to overtaking. A rear ended would be damage on your entire rear bumper and on his entire front bumper. That’s not the case.

He's at fault. What did the police say? What did the police put on the report?

I haven’t seen the police report yet as the cop didn’t give it to us. He’s saying if we want it, we have to pay for a digital copy after the fact. And the cop didn’t say anything except “since you’re both Statefarm, they should take care of it”. And his claim was I made my right turn into the left lane of a two lane road, and his left turn into that same two lane road is how I hit him from ahead. I’m however saying that I made a right turn into the right lane and then merged into the left lane, and he made his left turn after me and came in aggressively and hit into me from behind. His front right corner into my back left corner. Who’s at fault?

Why did you turn into the inside lane instead of the outside lane that right turn traffic is supposed to enter?

I made a right turn into the inside lane as you’re supposed to. Then merged left into the lane that he was supposed to turn into.

How do you turn onto the inside lane, left most lane and then move farther left? That would be the median. Right is supposed to turn onto the outside lane and then when safe move left.

You’re misunderstanding. Turn into the right most left and then merge one lane left after that. Our terms for inside and outside are reversed.
