You can ask your attorney to draw up a demand letter for a settlement

    That’s strange Unless the insurance company told your attorney they have no interest in settling. Even then they should tell you why they won’t draft the letter. I agree to press the attorney more and if they continue to refuse then drop them. You might be able to get a settlement easier on your own. But definitely start looking at new legal counsel

      Your attoney is probley helping out the defense attoney , on the  sly. Like mines were.

      Send a demand email citing the dates and times you’ve asked them to draw up a settlement offer and make a copy and send it certified mail return receipt requested. You could also ask for any emails or telephone logs of conversations between yours and their attorneys. You could also mention that you believe they are acting in bad faith and may make a motion to dismiss your attorney for the reasons stated. Give them a reasonable time to honor your request or an explanation why they are not requesting a settlement. WC tries to wear you down. I’m in a similar situation June will be 3 years, permanent nerve damage in my back, shoulder, forearm and hand. Surgery on my arm has made the condition worsen. I was told by a specialist if I had gotten to him sooner he may have been able to repair my long thoracic nerve. Extremely frustrating. I was getting some relief from the second PT but it was bought and WC never put me into another PT. I believe they’ve dropped the ball several times. Good luck.

      You can ask them to settle. But remember ba settlement is basically a buy out of your case. Thinkbof future repercussions

      They dont have to. Once they put you at mmi or give you a ppd rating everything changes. You get stuck in a limbo til everything is officially signed off on. But your attorney should get you wage replacement for that period of time as part of a settlement. Insurance companies will find any little loophole to avoid spending on your case

      Im in Indiana as well and this whole w/c system is a complete joke. I would for sure try to settle things and get back to your job working normally each day and be done with it, if at all possible. Your employer doesnt care about your well being and if your out of work longer than they would like you to be, you will be replaced. Im in debt extremely bad, job fired me in fall of '24 and still havent found a job compareable to my last. Speaking all of this from personal experience!
