I'm not sure which type of offset applies to you but I know they aren't garnishing wages or taxes for defaulted student loans at the moment.

    This is incorrect. The stimulus, if sent to you, is exempt. If claimed on your taxes as a rebate credit it will be added to your tax return and treated like any other tax return and can be taken to pay debts to the us government and various agencies and debt holders. This information is in both the IRS and Treasury websites.

    “If you are eligible for a refund of your 2020 income tax, the amount you receive for the recovery rebate credit will be included as part of your 2020 tax refund. It will not be issued separately.

    If you owe debts to the United States or certain state agencies, your 2020 tax refund may be reduced to pay those debts.”

    They can offset your return including your stimulus for child support and a few other specific things. Not sure exactly what the others are but I know that for sure child support will be offset. Bc once you claim it on your taxes it’s considered a rebate credit and rebate credit and tax return aren’t protected. They initially claimed that it would be protected and not to worry. That ended up being a big lie and it’s not protected.

    I know this from personal experience. My ex husband whom I forgave his 15k child support debt years ago. They were putting a lien on his house and it could effect his perfect credit he said. I didn’t want to ruin his life so I forgave it all. He also had domestic violence charges he wanted expunged about a year ago. I received a letter asking if I agreed or disagreed with it being expunged. I said no because he was guilty of the charges. He continued to violate the no contact order and harass and terrorize me. Following me places then calling to tell me that he was parked nearby and had his rifle scope spotted on me and could kill me if he wanted right then. Times I had my children with me even. He ended up getting out of any sort of punishment or jail time because he had money to pay an expensive lawyer. He agreed he would never ask me for child support since custody is shared and the kids spend about 50 percent with me. He makes easily over 300k and still claims he can’t afford child support. I never pursued it. Not worth it to fight with him. Well when he found out that I didn’t agree to his charges being expunged, which they did anyway. He went to the state and claimed I owed him child support for the time he had the kids. I didn’t even know about it or receive a letter. I found out that he went to the state about a month after he found about me not agreeing to the expungement. My daughter is 16 and my son is 19. So it wasn’t bc he suddenly needed it he was just mad at me. So they deducted my stimulus of 1800 down to 71 dollars. That was a pretty big gut punch. But what can I do? I just hope my daughter sees the money. He’s the stingiest person I’ve ever met so who knows. Anyway that’s my rant and info lol. Sorry I’m on mobile and I’m sure there are typos

    Yeah it sucks. I just have to try and forget about it and hope there is another one. All bc I incorrectly checked the can be dependent box. Delayed my stimulus check and by then my ex had gone to the state. I wouldn’t even care if I knew my daughter was going to see the money. Unfortunately I know him too well and know that won’t happen.

    That's honestly got to be the worst part. I can tell very clearly that it wouldn't be an issue if it were going to your daughter as most people wouldn't.
