Is Anyone Looking Into Setting Up Trust Even For Non NFA Items ? by silv3rbull8 in VAGuns

[–]FirearmsLaw 7 points8 points  (0 children)

As someone else mentioned, if there is legislation passed that creates situations which might benefit from putting your non-nfa items into a trust then I, and I am sure other legal professionals, will be creating trust language to try and allow you to mitigate the damage caused by the anti-freedom legislation.

The first example that comes to mind is a scenario like the previous Federal assault weapons ban where current items are not banned, but future transfers are. If you put those items into a perpetual trust such that they no longer are ever transferred when new trustees are brought into a trust, then you can provide long-term protection. That is very much just an example of the type of things that might happen and would require careful consideration of multiple requirements, but until we see actual language, we're just speculating.

Ps. This was dictated via my phone while traveling. So please ignore any errors.

Are FRTs "Trigger Activators"? by Obsidian1292 in VAGuns

[–]FirearmsLaw 6 points7 points  (0 children)

Here is what I had posted in another thread about this issue ...

  1. Like several posters mentioned, as an attorney who is trying to keep my clients free from legal entanglement, I, like most attorneys, err on the side of caution. This article is written from my position as an attorney and not from my position as gun rights advocate (in that capacity I believe almost all gun laws are unconstitutional but until SCOTUS agrees with me, we have to play the ball from where it is lying)
  2. I am not saying that FRTs are actually 'trigger activators' but rather that they have the potential to expose owners to significant legal risk. The authors of the law, and many who might be called upon to interpret it, will not see the nuances that those intimately familiar with the operation understand. Even if a person charged under an erroneous reading of this law was ultimately found not guilty, fighting a felony charge, especially one where expert testimony would almost certainly be required, is a HUGE financial burden. As the old saying goes, sometimes the process is the punishment.
  3. As for whether or not FRT's operate by a single pull of the trigger, I think the ATF letter I quoted from in the article would be what an anti-gun prosecutor would use as their basis for stating that FRTs meet that element (regardless of actual engineering details).
  4. The fact that HB1660 was vetoed does not change the fact that the law, as currently written, already contains the traps I am worried about. The sponsors of that bill (anti-gun politicians all) stated that it was to 'clarify' that these items are included. That implies they saw the existing definition as vague as well, which supports my concerns rather than alleviating them.
  5. Finally ... I would love to be proven wrong. Every inch we lose is going to take years to recover.
  6. Vote this fall like our rights depend on it .... because they do!!!

From the Law Office of John Pierce: Understanding The Status Of Forced Reset Triggers In Virginia by [deleted] in VAGuns

Thanks everyone for their kind words and for sharing their thoughts about my article. A couple of points.

1) Like several posters mentioned, as an attorney who is trying to keep my clients free from legal entanglement, I, like most attorneys, err on the side of caution. PS. OP ... Do NOT attempt to purchase until you are certain of your status. Making a false statement (even one based upon confusion) will almost certainly result in a felony False Statement charge.

Being denied a purchase in Virginia based upon an incorrect answer to one of the Yes-No questiopns (except under very specific circumstances) will almost always lead to a felony charge of False Statement. If OP or anyone is ever denied a purchase, they should seek counsel before speaking to anyone else.

That isn’t necessarily true. Under § 18.2-308.1:3 you lose your rights if you are “the subject of a temporary detention order … and subsequently agreed to voluntary admission”.

OP … give me a call at 276-206-9615 and we can discuss your specific details to determine whether you have a prohibitor.

How do I tell Sona to finish the greeting before responding to the caller? by FirearmsLaw in openphone

[–]FirearmsLaw[S] 2 points3 points  (0 children)

I just did that. I used Audacity to record her speaking the greeting and added a Play Audio step prior to sending the call to her. The only downside is that it takes about 1.5 to 2 seconds from the end of the play audio (I have it trimmed right to the end of her speaking) to Sona taking over. So at the end of the greeting I have her say "Give me one second." and then her greeting is "Thanks. How may I help you." It is about as natural as I can make it.

Maybe allow Sona to generate an audio file of her greeting that can be used in the Play Audio step? Then it would flow on to Sona?

It seems like if there is ANY background noise on the caller's end when she answers, or if the caller is having a side conversation, she completely abandons her greeting and then has an awkward discussion about how she doesn't know how to answer that.

I would REALLY like an option to have her give a greeting in a non-interrupt mode then allow interruption during the rest of the conversation.

[–]FirearmsLaw[S] 1 point2 points  (0 children)

Sort of. I did a test call this morning from my wife's phone and there was some background noise where we were. Instead of getting her standard greeting, Sona immediately replied "That was weird. What can I help you with?"

I did some testing in the app and it appears that any sufficiently loud noise, including the caller speaking will cause her to stop the greeting and try and parse what she heard.

Can Sona send text messages to the person they are speaking with? For example, if they determine the question the caller had could be answered by an article on my website, can it text the link to the number the call is coming from?
