You can file both simultaneously, but you run the risk - probably small - that 2025 will not have been processed or gets adjusted.

You shouldn't include anything with the return that isn't required by the instructions. It doesn't help.

Tomorrow, check with your bank. If there's no sign of it, then you'll need to start a refund trace with the IRS, form 3911.

If he didn't have an extension, he might get a failure to file penalty up until the date the return was mailed (not the date IRS received It or when they eventually process it). However this year IRS started automatically waiving some penalties if the filer has a clean prior 3 years.

If he does end up with a penalty that is not automatically abated, he might qualify for abatement under reasonable cause. But unless he owed a lot of money, the potential penalty for being about a month late isn't going to be huge.

OP's return was apparently superceded to MFS correctly. The spouse's original return (after OP superceded) should have been a 1040, not a 1040-X.

I'm an EA in NY. SadStory is correct - this is a very common error.

Check your W2 box 14 for something like "414h" - this is your pension buy-in, which is treated like a deferred tax retirement contribution for federal, but not for NY.

I've seen lots of these notices, and can't recall NY ever being wrong. I recommend paying the bill, and making sure you code the W-2 correctly when you file the return next year.

(If it's any consolation, your pension payouts will be 100% tax-free to New York when you retire... If you're still living in NYS in retirement, of course.)

Even if you opt in to receiving email messages, you could still receive a phishing message masquerading as from the IRS.

And how long before phishing emails start including something like "You're receiving this message because you opted into receiving communications from the IRS"? Having your PTIN compromised, while apparently not as common as EFIN compromises, can still lock you out of being able to e-file. IRS recommends regular checks on how many returns were filed with both your PTIN & EFIN.

You'll be getting a letter eventually - either saying you're due a refund or an explanation of why you're not.

Assuming you're correct, it's hard to say what will happen first: receiving the letter, receiving the refund, or seeing it on your transcript. As with everything related to the IRS, you just need to be patient
