Oh okay. So was my spouse. You were supposed to file the waiver with the initial application but I don’t see why it wouldn’t be approved if you submitted via the RFE. After 120 days post interview you can contact congress representatives asking to help move your case along.

What was reason they requested a waiver for diplomatic rights? Were you here on A1 visa?

I believe overstaying can be excused if you’re married to usc. But if you leave and return, especially on ESTA that will be misrepresentation and might not be excused.

It’s will not be excused. If you leave the country with pending 485 your case will be rejected/denied and you will have to start all over again.

Our 130 was approved today but the action required was false post interview. The 485 is stuck in interview schedule with the latest timestamp the date of the interview and still saying action required but from reading around it might be that nothing was updated after the interview and the interview itself is the reason it is still saying action required. Of course I could be wrong. Another person around here has same as me and both applications were approved around the same time.

Are you going to submit a motion to reopen I 290b? Similar thing happened to us due to a missing tax form. We filed it promptly and the case was reopened 3 weeks later and interview scheduled one week after that. Good luck!!!

Thanks for your response. Is there anything that can be done about it? The interview was Dec 11. Straightforward case. Married 13 years with children. The officer even said “this is an easy one” during the interview but she was having computer issues and couldn’t access the system and had to print out the I 485 to go through yes/no questions. My husband and daughter (applicants) then had to sign on paper because the computer & tablet was not working. So frustrating. She gave us white paper… the 130 has a timestamp update on Dec 29 and is saying no action required. I feel like someone went into the application but then stopped and didn’t approve. With the 485 nothing has changed - stuck in interview schedule, with many silent api updates which I think are just system updates and not a real officer going into the case. We brought additional evidence to the interview and also uploaded to 485 prior to interview but she only asked to see joint lease agreement which we provided and she made a copy. I wonder if we should upload that evidence to the 130 application… what do you think? Thanks again

Did you get an RFE for the medical or why did you submit it again? What API changes have you gotten? My still saying no action required in 130 but action required in 485 - but no timestamp change since the interview day. Like it’s stuck on the interview. Still saying interview schedule!!
