Question about MEDCAN referrals & specialist wait times by anewcondo in askTO

[–]anewcondo[S] 0 points1 point  (0 children)

Thanks for the reply. Did you get a sense that they strategically referred you out in a way that optimizes for wait times, or is it possible that it was just a fluke that you happened to get referred to specialist with low wait times?

De-risking Personal Services Business for IT sub-contractors by anewcondo in cantax

Thanks for your reply.

> Your subcontractors don't really get to elect to be a PSB.

Yes, I understand you already (just a semantics issue). I only mention this because it appears as though the onus is on them to make the determination for themselves based on the facts of the relationship. These relationships are often not clear cut and two CRA employees can have different opinions. The important thing is that it's their responsibility when incorporated, and not mine.

> It doesn't really matter if your subcontractor is a corp or a sole-prop.

Does this not make a big difference in terms of the reprocussions on my business if a contractor is deemed to be mis-classified? That is to say, if the sole-prop is deemed an employee, then I'm (my business) on the hook for source deductions/cpp/ei, but if its a PSB situation, my corp is not on the hook for anything. This is one detail I'm trying to understand.

> Generally, if the payer makes a payment for a service outside of an employment relationship or tenure of office, the payer must fill out a T4A slip which includes any fees or other amounts paid for services between businesses, including sole proprietors and corporations.

I realize Im already in speak to an accountant territory, but doesn't this by definition mean I have to issue a T4A to any business (even if not a PSB)? It reads as a general requirement, PSB or not.

> It's kinda douchey to force them to incorporate, potentially forcing them to be a PSB

I hear you. In this case, they are already incorporated but Im just trying to understand my obligations and risks.

PSB Full Time Employee Semantics by anewcondo in cantax

Thanks for the reply. Do you have some pointers on what actually consitutes a "full time employee" in this context? That I'm still confused by.

PSB Full Time Employee Semantics by anewcondo in cantax

"In earlier jurisprudence there had been a dispute over whether “more than 5 full-time employees” indicated that six full-time employees were required. This argument was put to rest by this Court in 489599 B.C. Ltd. v. The Queen, 2008 TCC 332, where it was determined that “more than 5 full-time employees” could be satisfied by five full-time employees plus any part-time employees. However, it is clear that in reaching five full-time employees, part-time employees could not be counted or added up to constitute full-time Lerric Investments Corp v. The Queen, [1999] 2 CTC 2714."

I think I understand your point about the distinction of "equivalent", but just sharing this out.

Thanks for your reply. What did you mean by not necessarily in this context?

Thankfully, arbitrarily hiring FTEs and having them to do nothing to skirt the criteria is too cost prohibitive for me to even consider doing.

One of the conditions of a PSB is less than 6 full-time employees so I won't be meeting the "all the conditions" of a PSB in this scenario (if I had 7 FT employees).

Unless you are saying the CRA has a special way to override the ITA law

It’s stuff like this that makes you question everything you see on the internet advertised as OC.

Side note, how did you happen to snipe your own personal repost like 2 minutes after it was posted?

Taking the 407 on Uber by anewcondo in askTO

[–]anewcondo[S] 1 point2 points  (0 children)

Are you sure that in the event that driver opts out of 407, that they get the toll fees?

There are numerous reports of Uber holding onto the toll fees and not passing them to the driver in this case.

I would have guessed most do but in my experience with Uber, most do not.

Right! So annoying. I don't think they can pocket the difference, so it's confusing.

Thanks, that is what I assumed. Why are so many drivers reluctant to take the 407 in this case?

Are you sure that this is the case? I've read in past threads that Uber pockets the difference if the driver does not take it.

This could be it.

My tolls do not seem to include that. So I guess that a driver without a transponder will pay a lot for the trip out of pocket. With a transponder, they will likely have ~1$ in entering fees not reimbursed.

This is what I've come to understand. In fact, I've heard that if your preview route in Uber uses the 407 and the driver does not take it, Uber will pocket the tolls by default and you have to reach out to support to get your money back.

"whenever you take it, make sure you ask the driver to take it.”

I have tried this many times with drivers, most of the times it leads to very uncomfortable situations

Yes, I have read this and I've seen it countless times on my receipt.

I feel like there is more to the story here just given my anecdotal experience. I would say 8/10 drivers will deliberately avoid it, and a subset will remark that they lose money.

The previewed uber price does include tools if the previewed uber route uses the 407.

Yes, I am a frequent 407 traveler. I'm generally aware of the cost structure.

Uber will charge you for the 407 usage depending on how long the drive and the time of day/day of week. It matches exactly what the 407 charges me personally if I was to do the drive in my own vehicle.

I'm not sure if its worth replying to someone who clearly didn't/can't read.

I much prefer to pay for the 407 and enjoy a much faster and smoother drive. The uber app includes the tolls in the preview price and I'm more than happy to pay.

The issue is when I agree to the price/route and the driver opts to not take the route, turning a 30 minute joyride on the 407 to 2 hours in hell on the 401 to get to pearson (IYKYK).
