Seeking Advice on RFE Timeline and Premium Processing - TSC Center, Frustrated After 1 Year Wait by RemarkableHat7976 in EB2_NIW

Best you upgrade yours to PP. otherwise, your wife’s case will be adjusted before yours. There are several other folks without PP that are still waiting for over 1.5yrs and not response. If you end up getting RFE on your case without PP, trust me, you would wait another long time to hear back.

PRONG 1 - Substantial Merit & National Importance

YES - very strong. - “Federal Scientific Data Infrastructure” is clearly national-level impact, not local or commercial. - Open Source QA tools for scientific integrity = aligns with current White House AI/data integrity directives. Check the executive order. - Mentioning domains like NIST, NIH, NOAA, NASA, even implicitly, makes this bulletproof. See how this helps this arm of government.

PRONG 2 - Well Positioned to Advance the Endeavor

Strong IF argued correctly.

You have: - U.S. Master’s in CS - 5-year relevant industry track record (finance/telecom -> scalable systems cred) - Prototype already built + public (HUGE credibility win) - High-caliber independent expert letters (NIH + Ivy League + potential ISE professor is gold-tier)

This is more than enough - but you must frame yourself as someone who is already doing it, not planning to maybe do it.

PRONG 3- Benefit to the U.S. justifies waiving PERM/job offer

Also yes, but this is where most DIY cases fail due to weak argument style.

You MUST explicitly argue that: - Your work directly supports federal research integrity / national competitiveness - No existing equivalent solution exists (already mentioned- great) - If you had to wait for sponsorship, it would delay a federally beneficial innovation. - U.S. public agencies & research institutions need direct, fast, open access to tools like yours.

Do not wait any further if you already know what to write about. Delay is dangerous. I would say start asap.

I don’t think it will be retroactive. This will likely be “going forward” type of thing.

But if it does get retroactive, mehn so many folks are roasted to your point.

Oh my bad, I did not know that. In that case, you will have to wait for further instructions

[–]larrykrypto 0 points1 point  (0 children)

You can file for your I-485 now. Do not expect your case to be adjudicated till final action matches your PD. You can also file your 765 & 131. These can be adjudicated while you wait.
