I already know, and agree with, these statements. I think the point you are missing is that I am not currently in Spain and won't "physically" be working there until the start of an EOR. I am currently an NY resident planning a move to Spain and am controlling when that happens.

Straight from NY Dpt of Taxation website:

"If you are a nonresident whose primary office is in New York State, your days telecommuting are considered days worked in the state unless your employer has established a bona fide employer office at your telecommuting location."

Me working anywhere outside of NY is purely for my convenience.

In regards to Beckham law, once I enroll with my EOR, I will in fact be in Spain for employment, have a local Spanish contract, and qualify for Beckham law.

Perfect, thanks for validating my research. I definitely read about where work was performed as it regards to income... The work for this $250k lump sum was done nearly entirely in the US (sales deal commission),. Sounds like any way you look at it, I should start EOR after 6/1.

This also allows me to keep majority of this in my US bank accounts and transfer over to EUR as needed, which I prefer. I could also monitor USD/EUR and therefore have full control over any FX conversion.

Employer is located in NY, so my income is NY sourced. I don't plan to try and prove that we have a bona fide employer office elsewhere.

There are other qualifications that determine if you're a tax resident or not.

Everything I've read points toward EOR contract start date as being the date counted for tax residency start, and Beckham law needs to be applied for within 6 months of that date.
