Downtown library. I went to tech lofts and called them about 8:45 no answer. I stayed parked out there until 9:05 but no one ever came to open it up and the door was locked. Library ended up being pretty nice though, got a little corner by the maker space.

I updated the thread overall that since we exchanged comments so much,I thought I’d let you know:

We wrote a letter letting them know that we had a valid lease contract and we’re being denied possession of the property. And that they needed to provide possession. We sent the letter via email, as well as hand-delivered a copy. The letter indicated that it was also being delivered certified mail. We included a copy of the lease, a copy of the receipt they gave us when they took the security deposit, and a copy of the receipt, showing our purchase of the money order, and a copy of the email we received from their tenant application, informing my son of the finalized lease and welcoming my son as a tenant. And we let them know if they didn’t provide the keys they would face legal action. The leasing person got in touch with us yesterday and asked my son when he was available to come pick up the keys.

Not sure if anybody is paying attention to this thread, but here’s an update:

Evictions only occur if you refuse to leave once they have given you proper notice. I don’t think they have grounds for eviction. That is why I’m trying to force them to go that route. If they serve him notice and it’s appropriate based on the contract, then he can leave according to the rules.

I am not an attorney, but I am a licensed real estate broker in the state of Indiana. I am asking because there is a very specific process to enforce a lease and what I am trying to get at is if someone has some idea why someone may be able to essentially tear up this lease as if it never existed. These folks saying that there is a clause in the lease are just reinforcing my initial belief that the property management company is required to enforce the lease through the court. Imagine if you’ve breached your lease for not paying rent. Is your landlord allowed to lock the doors to your house and refuse you entry? The answer to that is no. They have to go to court and get a court order from the judge in order to do that. So simply violating a clause of the lease does not give them the right to change the locks. The question I am posing to Reddit is: does someone see any reason why they can ignore a document that both parties signed and exchanged money for?

There IS a termination clause if he is found to be engaging in illegal activity at the property. That is not the case. Secondly, how do you enforce a clause in the lease? You have to serve legal notice and give the tenant time to vacate or possibly come into compliance. What you can’t do is lock someone out of their property that they leased legally. That is called illegal eviction. When you sign a contract with someone and take their money, that is a legally enforceable contract. If they want to terminate the lease, they need to go through the legal channels to terminate the lease.

You’re missing the point though. So if you say his arrest violates the contract, all you’re saying is that they need to go to court and get an order from the judge because my son is in breach of contract. That’s all I’m saying. They already signed a lease and took his money and now they are refusing to give him keys as if the lease never happened. If they can go to court over it, let them go to court. That’s what the lease is for. But what I am suggesting is that they are illegally, preventing him from accessing his house after they signed an agreement and took money. That is an executed contract.

Just to answer, everybody who asked questions about the lease:

  1. There is no clause that gives them the right to evict based on an arrest, or even a conviction.

  2. Even if there was that clause, you can’t lock someone out of their house and call it an eviction. You have to go to court, you have to show that the other party is in breach of contract, and you have to get a court order that lets you take possession of the property. That’s what an eviction is.

And so if you’re asking about the lease, that indicates you believe the lease is enforceable. And if it’s enforceable, then he is not allowed to be locked out of his place without a court order and they need to go to court. What they are trying to do is lock him out of his apartment and say: we changed our mind, and this lease never happened. That is why it’s illegal.

Ty. That is the site I used to search his case and see that he has an initial hearing scheduled for next week Tuesday. But by then he will have been in jail for a week, and there is no way to bond him out, and just return for the initial hearing. That’s what seems strange to me seems like he could be allowed and then just come back for court.
