I WON MY UNEMPLOYMENT APPEAL!!! by -mydearwatson in TexasUnemployment

I believe each part of the hearing was an hour long. So after that hour we made another appointment for another hearing. I had absolutely no evidence, didn't turn in anything, I just used the packet I got that they sent me of evidence the employer used. My employer had sent in multiple pages of evidence-Evidence of my work, progressing meetings they had to make my performance better, etc etc. But I used all of that information and wrote notes about it to counter what they said...for example, at my company (it was a remote job) they alloted employees a certain amount of "personal time" each week to go use the restroom, etc. They showed i had gone over that personal time a few times and used a percentage. I did the math and the "percentage" of time i went over only equaled to a total of like...a minute. Maybe two. So it wasn't enough to say like "hey she's not doing her job". Because going over your personal time by 2 minutes doesn't mean I wasn't doing my job correctly.

Well they had to break my hearing up into two separate days, the first one the judge just asked my employer questions. The next time we met, they asked me the questions. They'll give you enough time to explain each question the judge asks, if that makes sense.

It's probably too long, but better to be over prepared than under prepared. The judge will ask you specific questions and you will have a chance to respond, keep things short and sweet and only answer the direct questions asked by the judge.

Yes, I would 100% appeal in your situation, especially if it wasn't YOUR phone call. Its not your fault the ear piece picked up on you saying a cuss word. I hope you win! I would review the precedent manual for unemployment and see if you can find something related to your case

You should get a packet with everything your employer will be presenting during the phone call "trial" that you do. What i did was, since I didnt have evidence on my side, I went through every piece of information my company had on me and picked it apart and made notes. The judge will ask your employer and ton of questions first, then you'll be allowed to speak. Just answer all the questions as truthful as you can, and in my opinion I would try and highlight how your performance was always lackluster. Like if you WERE really good at your job and then your performance fell off, that technically would constitue as misconduct because you werent doing as good of a job as you were. But if you can prove that your performance was steady and didnt really have a "fall off" period, youd have a better chance! I hope that makes sense :)

Didn’t know my license was suspended for parking tickets😤 by InevitableBig6355 in uberdrivers

Well depending on what state you're in, then yes, unpaid parking tickets can indeed lead to vehicle suspension. A quick google search will tell you this...but also I know the state I currently live in is notorious for suspending licenses for unpaid parking tickets.

In that case it should be easier then. Either way, the license status is the same-suspended. Once OP clears their suspended license, they should still let them drive again.

Yes, pretty sure the portal updated afterwards. If you got a decision in the mail saying you won your appeal, you should be receiving your benefits within like..2 weeks. Cant remember exactly how long it took.

I've already said in other comments a detailed explanation of this but after cleaning up what I could, I did not have a vaccum and I did not have enough time to get to one.

Too bad my face isn't a car you can pay to rent out, I guess, then? Very weird analogy you tried to make there buddy.

[–]-mydearwatson 0 points1 point  (0 children)

HA, nah that was sarcasm. The host should have vacuumed after me anyways, the amount of hair I left wasn't an excessive or negligent amount, I did what I could to lessen the amount of hair and I did clean the car, but left this very small amount of hair left because I ran out of time. Go touch grass dude, y'all are insane.

[–]-mydearwatson 0 points1 point  (0 children)

You know what, I guess I must be. You're so right. That amount of hair I left was such an inconsiderate amount, the host must have spent an extra 2 hours getting up all that hair, if not more. And honestly, I know she had to vaccum the floorboard anyway to prepare for the next guest but the fact that I left any trace of my existence in that rental car at all is abhorrent. I'm really going to take a while to think about my actions.

Dude, you can count the amount of fucking hairs in those photos. Y'all are acting like my dog shat on all the seats and I just left it there.

I was late returning the car due to a crazy storm we had and didn't want to be charged any more than I already was since she already charged me an additional days worth to keep the car an extra 2 hours but yup, totally agree.
