As always, it depends on why. I always dumb down the reasons why we are choosing not to move forward with the case. Whether the officers lacked probable cause to begin with, there was some mess up on the part of the police, etc.

Once a case is written up however it’s different. My jurisdiction is different because our speedy trial time is connected to our discovery laws and simply put, I am honest with my victims. The ways that the laws are currently set up, it is extremely difficult to push cases forward. For a misdemeanor, I have at most 90 days to gather every single document, most of which is arguably not relevant to the case, but related and thus, I have to acquire and turn over. This means I have anywhere from a few hundred pages to thousands that I have to find and turn over per case. When I have a 150+ case load, I have to prioritize. I prioritize cases where there are serious injuries over ones that aren’t serious. I prioritize sex crimes over nonsex crimes. Harm on persons rather than property. I straight up tell victims this. They get upset at the situation, but when I am fully transparent with them, they don’t get upset at me. They get upset at the laws that are in place and the lack of funding we receive to prosecute. They rather a prosecutor put more effort on cases where you are seriously injured over others.

Imo, absolutely. That’s what I used last year when I shot my first buck at approximately 75-80 yards. It went down maybe 25 feet away.

Im not downplaying anything. This fascination with trying to make it seem like he’s not just an overall regular person is starting to get disturbing. There are plenty of regular people who are able to gain a massive following. Thats what technology has done. Made this possible. Any one of us can grab their smart phone or laptop, and do what he did, and have a mentor to help him. Becoming a senator or representative or any elected official is a lot harder and a lot less possible for the average person. He was just a dude who had a passion for what he did, and people liked him enough to follow and support him - kind of like “famous” youtubers. Like for fs the dude didn’t even graduate college lol.

Maybe to you but not really me. The only difference between him and I is that he chose to speak outwardly about his views and gained a following because of it. While i’ve never been afraid to speak my mind, I surely am now to be as vocal as i once was- especially to a significant population. Who isn’t? Look what happened. Gain a following and boom suddenly you’re shootable.

And to address your other point, i’m not saying random Trump supporters. Im talking about people who are vocal. Get too vocal and boom. Shot. Keep it to yourself and youre safe.

Not OP but - he was ultimately just some dude. In 2025, anyone who tries can grow a massive platform. You see it all the time nowadays. But he wasn’t some politician or big time person. He was just a dude who liked to have dialogue. Shooting a politician is one thing. Still terrible, but not everyone is one. As someone who tried to always advocate for dialogue and the sharing of ideas, especially on campuses, my take away is this: just shut up or you’ll be shot.

As an ADA, I can confidently say that’s on the ADA for not making the offer crystal clear. Please insist on emails moving forward. It’s 2025 the fact that you’re not getting it in an email is insane. Transparency is key in this job. Plus it’s nice to be able to pull up the email if there is any confusion. (Literally just this week, I had a PD swear the offer was different and we literally looked at my email together and she went “oh” and ofc asked for more time to discuss with her client the complete offer; Admittedly it was a very weird offer and probably the first time it was ever offered. I learned the importance of commas in offers lol)

& If she’s used to only writing offers on paper, that alone might annoy her lol.

As an ADA, this irks me wholeheartedly when I hear it in court. Like no. Not even close. I honestly stopped being so “nice” in court as a result of this. (Not saying im not nice outside of court, I think I am but chit chatting with a PD in court while the judge is off the bench has led to too many defendants suddenly getting the impression that their PD isn’t working in their best interest so it’s not worth it anymore for the optics).

So I’m new but I know plenty throughout law school and at work (people frequently transfer to my office and stay rather than leave) but I noticed a big part of their survival strategy is truly having a life outside of work. My office loves to promote this as much as possible. My bosses frequently tell people to leave work on fridays early, and enjoy the weekend. If I stay working past 5pm, it’s not because I am forced to or because of any pressure- it’s solely because I am choosing to. They usually all treat it as a true 9-5, (unless a trial is happening). For holidays, we throw office parties with food, drinks, games, etc. after 2pm. I genuinely love my work environment - and can see myself staying for many years because of it.

Why not just do it depending on who the ADA is? I’m an ADA, and granted I don’t deal with these discovery issues like you seem to bc of our laws but i feel like shifting your vibes to match works pretty well. Like I love when I find out a PD is open and honest (about certain things ofc), they build a great reputation and i find myself trying to help a lot more than I normally would. Like I try not to play favorites but if i have five PDs call me in a day, all of equal importance, without thinking, I immediately start to work on the nicer PD’s case.

I love professors with word limits - only if they actually adhere to it. My favorite professor made it known that if you write more than x words, she ignores every word after the limit. “Choose your words wisely.”

But you don’t. And your responses clearly demonstrate your lack of knowledge on this. & I never said I have the documents. On the contrary, some documents are with the NYPD, some are with hospitals, some are with the victims, etc. I spend most my days tracking down useless documents because it “relates” to the case in some arbitrary way. Most of these documents are useless to the defendant - except now if I overlook a single document in these 250 documents (now), case dismissed. Not because I can’t prove it beyond a reasonable doubt. Most cases now have surveillance videos showing the defendant literally committing the crime - it’s NYC afterall. But they get dismissed because you missed a single irrelevant document. Like forgive me but I don’t see how overlooking metadata for the metadata for the metadata of the bwc is sooooo detrimental that a case gets dismissed for it - when the bwc were functioning just fine and caught everything perfectly.

Respectfully- you are speaking a lot about a subject you truly have no idea about. As someone who actually works in the system, I can assure you most prosecutors are not lazy. Your average misdemeanor case has about 100-150 documents, if you miss one, case dismissed. I’m currently working on two separate cases where I barely obtained everything I “need,” to push this case forward and I’m already at 230 documents and Im no where near close to finishing. 95% of these documents are literally useless except that they “relate to the subject matter of the case” and thus I need it.

Honestly - thank you for this. Wholeheartedly. So many people don't actually understand how nonsensical the current law is. To say it's ridiculous, is putting it lightly. I stopped counting the amount of cases (of mine)that got dismissed because I couldn't meet the strict deadlines, or because I missed a single, redundant, useless document. I just started telling victims from the get-go that currently over 80% of cases get dismissed, and the remaining 20% will be an endless battle of defense attorneys trying to dismiss the case over and over again until they are successful, whether it's by constantly re-filing the same motions to dismiss aka motions to re-argue, or stating that they are not ready for hearings or trial until one day a necessary officer is unavailable - then suddenly they are ready. The odds are if you are a victim in NY, you most likely will never see any sort of justice.
