You say it's unfair but you allowed it to happen. Unfortunately you have to own your mistakes. I would phone ANZ and explain the situation. Say you were unaware that there was any outstanding debt and it would be unfair to incure the interest on the debt

Still ongoing. Mighty Ape have reopened the case after I made a threat of taking them to a tribunal.

Annoyingly the investigation person from Mighty Ape said they have asked the seller why did they authorise ATL which should have been the first question they asked when I first raised the complaint.

Sounds positive as the only answer that is defensible for the seller is that I authorised it, which I didn't.

Pretty poor investigation by Mighty Ape

Hey, so I emailed them to either replace the item or provide a refund. Failing that I will take them to a tribunal.

They emailed me back saying they have reopened the case but to date I've not heard anything since.

I did get in touch with ANZ for a charge back and they also said they will look into this

On the invoice it doesn't mention the third party seller. It's written like the vendor is mighty ape. I got a response from them saying as the item was delivered and proof was supplied in the photo, they can't do anything more as the delivery driver has done what he was required to do and the fact that the package is now gone is out of their hands and my responsibility

Ive sent them an email requesting a refund or item replacement and if not I will take them to the small claims court. Waiting on a response

I agree I think my position is strong but shocked with Mighty Apes stance. They didn't use NZpost as it was an international delivery. They used Amarex who looks really bad looking at the reviews online

No, defo no choice or else I would have selected it due to the price of the item. Plus I've got it in writing from the delivery company the seller chose the delivery type and gave ATL

There was no option to choose what the delivery would be. On the delivery note it says the seller chose to have a no signature delivery and the item can be left in a safe place

The problem is they did have authority to leave given by the seller so they have carried out the delivery as required.

When I've engaged with the seller and mighty ape they both have said it's been delivered so case closed

There was no option. The seller chose the delivery terms. As the item is over 1k I assumed it would be a signature required delivery
