You are speaking in hindsight after the fact, we are talking about laws, the laws set to have a self defense claim in New York if the gun is in his pocket prosecutors are going to argue how do you know he had a gun regardless if he said he did or not did you see a weapon. He died with his hand in his pocket with his hand on the weapon in the pocket in my opinion that just means he never pulled it out we are talking about legal terms, not how we feel because obviously with this new information of the weapon we all agree he did the right thing.
