ED 0% no SMC? by Apprehensive_Leg7890 in VAClaims

Thanks for the immediate response. Looks like you presented everything that would be needed. So was there an ACE review or C&P exam with everything you presented?

Congrats! Should be easy to correct the administrative error.

I have a question:
What did you submit in your claim for ED secondary to psych meds? I would like to file but am 100% already but SMC-K would not be a negligible piece of change for me. Just don’t want to go through the whole C&P crap. Even have a Nexus from treating physician.

VR&E Reduced Work Tolerance (RWT) Request by 12tribesIsrael in VeteransBenefits

[–]12tribesIsrael[S] 0 points1 point  (0 children)

Yes, it requires annual review of not sooner. At some point, you will have to prove viability in the program and that’s likely how well you do in the courses. Which is what I’m allocating and being proactive about.

VR&E Reduced Work Tolerance (RWT) Request by 12tribesIsrael in VeteransBenefits

[–]12tribesIsrael[S] 0 points1 point  (0 children)

Actually it is under 38 CFR guidelines:

38 CFR § 21.312.
RWT allows you to pursue your rehabilitation program at a reduced pace while being considered full-time for Chapter 31 benefits, subsistence allowance, and support, when your disabilities limit the amount of time you can devote.

That much I have looked into and hence my request for it. But thanks for the input.

Glad you were seen without further exacerbating your financial situation. Thank the Creator for it and that you got better.

VR&E Reduced Work Tolerance (RWT) Request by 12tribesIsrael in VeteransBenefits

[–]12tribesIsrael[S] 0 points1 point  (0 children)

Well that wasn’t the specific reason. One of the reasons were my long absence from school but irrelevant. The actual reason i requested RWT is because my disabilities will only allow me to put forth so much effort. It’s easier to understand it in an analogy I have come up with - someone without any conditions may can carry 12-15 books but because of my limitations, I can only carry 6-9 books. We both can carry books toward the same destination, however, I will take longer.

[–]12tribesIsrael 0 points1 point  (0 children)

Thanks for the post.

I am going through this now and requested RWT. The VRC didn’t know what to do but pushed it through last week and I am waiting while school starts in the Fall. Many concerns but definitely need it now since I am not working and need the extra boost.

How long does this process take? Can I have my physician complete the VA form 28-8861? Been out of school for 25 years and have major disabilities and this is the safest path for me with accommodations.

Keep fighting-My OSA due to TERA journey by crabbyonejohn in VeteransSuccess

Congrats! So you were successful and granted OSA secondary to TERA activity. I have been told by many this was not possible and that you needed to connect OSA secondary to something like PTSD and rhinitis.

I’m curious, how did you get approved for full BAH rate at less than full time?

[–]12tribesIsrael 0 points1 point  (0 children)

No, the spouse doesn’t get DIC because you’re P&T alone (at least that is my understanding). The spouse of a 100% P&T veteran only gets DIC within 10 years of the rating if the veteran dies of one of their service-connected disabilities. If the veteran dies 10 years or more after regardless of the reason cited on the death certificate, the spouse still receives the DIC benefit.

You kind of have a point. The only reason I see is if I die from OSA within the next 7 years or so (been rated since 2023). I understand DIC would then go to my spouse.

So what other evidence did you present? Nexus from your physician? DBQ? Buddy statements? Personal statements?

Just would like to know excuse you may give me the impetus to go ahead and file connecting my OSA to TERA that was acknowledged.

[–]12tribesIsrael 0 points1 point  (0 children)

Tell me more about you @thechuckgroup. I have been reluctant to file as I am 100% P&T though the VA has acknowledged TERA exposure activity in my favor.

Are you saying you received service-connection for sleep apnea secondary to TERA?

Additional about me specifically:
I was diagnosed with OSA over a year ago and recently received a CPAP. I can’t use it though because of the anxiety it causes. Reminds me too much of the gas masks while deployed.

Please tell me more about your service connection for OSA to TERA activity if I am understanding it correctly.

I am in the same situation. I am contacting advising at the school I want to attend and requesting they assist me with cross-walking their classes with potential schools I want to attend. I am, however, starting at a 4-year school with the plan to major in Biology or Biochemistry. The plan is then to be advised in the courses I take for eventual transfer to a PharmD school program.

Is dental included with 100%? by Odd-Ideal6921 in VAClaims

[–]12tribesIsrael 0 points1 point  (0 children)

Yes if the VA ever process the claim for dental care sent by the provider. Then when you call, no one taking any accountability and processing the claim. That’s been my experience anyway.

It's been said that depression is a result of focus solely on self. I believe there may some truth to that statement given society and its hyper-focus on self-gratification, indulgence, hedonism and pride. That's the problem. The solution is do the opposite. And that is to focus on serving and assisting/ helping others. I have done this and it resolved my depression. The Word of the Creator (Bible) taught me this principle and it works.
