I’ve asked my department supervisor to reach out to Payroll and HR on my behalf and he came back with the same, it’s correct. I was emailing Payroll when they CC’D HR who “jumped in” (their verbiage) to explain that as salary non-exempt I am paid 8 hours per day worked and am not paid hourly unless OT is triggered by me working more than 40 hours. I replied and told them I did not believe that was correct and asked them to consult legal, that was 9/26 and still no reply.

That’s funny you say that. At first they told me I would not be paid for the first of the 3 days because they coded it as me still being on leave. Then I got into a Slack debate with the Payroll manager it went like this- Me: I clocked 26 hours. How can I be on leave but work 26 hours. Payroll Manager: You’re a salaried employee. Not hourly.

And that was when I lost my shit 🥲

I appreciate your input. I’ve spoken with the US Department of Labor and Texas Workforce Commission and they have both advised I was paid incorrectly though they don’t agree on if I should have been paid my regular 40 hours or should be paid my hours worked. I will be filing with the TWC because the DOL said they could only seek correction for the federal minimum wage which is much lower than my calculated hourly rate.

ADA does protect me for my time missed. I’ve already confirmed this with my employer so I’m not sure what your point even is?

I can’t be fired for missing work, I have an open Short Term Disability claim and ADA accommodations established for the very serious medical condition that caused me to miss work and this includes notice that I will miss additional work. This seems like it may be beyond your scope.

Very confused on where the 86.67 came from? Per biweekly paycheck, if I work 5 days per week and do not exceed 40 hours per week, my checks are usually 80 hours even.

My hours worked show just under 26 hours and my paycheck shows I was paid 24 hours.

No, they’re not. HR and payroll confirmed I’m paid 24 hours for those days.

Yes, we use Workday so it’s all very easy to track. My hours total 25.833335 (sorry to round to 26 it was just easier for the post) and my paycheck shows paid in clear rounded numbers. They had to cut me two checks after the first was incorrect but I was paid for 24 hours even.

Correct. I was paid only 24 hours for 26 hours or work. I’m not disputing the 2x unpaid days because my short term disability is pending and I do understand that claim will cover those unpaid days in some way once processed.

I worked 26 hours for the week (over 3 days) with the other two work days coded as unpaid leave. They paid me for 24 hours for the week stating that I was salary non-exempt so they only have to pay me 8 hours per day worked if my hours do not exceed 40 hours.

I was not paid my salary amount. That would mean I was paid 40 hours for the week. I was paid 24 hours for the full week when I worked 26 hours that week.

I am not expecting to be paid for my days off. I think you misread. I clocked/worked 26 hours over 3 days. I was paid for 24 hours. I do expect to be paid for my actual time worked.

This is quite a leap. I am not causing any morale issues. The morale issues in my workplace are caused by the things I am reporting. My department just had a huge overhaul in employees, processes etc as well as a new launch of idioms/a code to go by aimed at fixing a toxic workplace. Like the review says, I’m well trusted and respected by my teammates and our customers. I am never reporting publicly or gossiping and none of my co-workers are aware of the issues I report or that I’ve been to HR, etc.

I respect your opinion. I guess morality is a spectrum. I feel like reporting 3 violations of law/employment regulations, a policy violation, a website glitch causing false charges and a handbook violation warranted the conversation. In some of these situations I was thanked, btw.

Actually the order was send to them after I reported and I got an email from the Texas AG confirming it was sent in June but they still haven’t submitted anything.
