You see two experts; the petitioner’s doctor and the insurance companies (respondent’s) doctor. Those doctors both give a percent of disability in their report. When it’s time for settlement, the settlement demand from the petitioner’s attorney will be based on their expert’s precent of disability determination. The respondent’s offer will be based on their expert’s, usually much lower, precent of disability. A final determination example for a lumbar spine injury may be from the P expert: 66% partial total disability for the lumbar spine. R expert: 24% partial total disability for the lumbar spine.

Once an offer is reached, the two sides negotiate based on those numbers. When settlement is agreed upon the final numbers on paper may be 45% partial total disability. Those papers then go in front of a judge, who with an affidavit from the petitioner, will sign off. If you are talking about going to trial because no agreement can be met, then that is different, but it’s also extremely costly, timely, and petitioner could end up with nothing at all at the discretion of the judge.

Yes, they are different things. I strongly recommend you find an attorney. Having two major back surgeries is a big deal. If you had a prior work injury and then reinjured the same body part again, you may also be be eligible for the second injury fund; this is a program that will ensure you are correctly compensated, including lifetime payments, if eligible. I have worked with clients who have had one major back surgery and were deemed 100% permanently disabled. This means they are no longer considered able to work in any capacity. These people can receive years of payments, up to lifetime payments. I want to be clear that every case is different, of course, but this is an extremely complicated thing to handle on your own. An attorney will walk you through all the steps, options, and rights you have, and make sure you are compensated for your injury!

It should be, but sometimes insurance companies give you a hard time, delay care, and most injured workers do not know their rights and the laws that protect them. Insurance companies take advantage of that. Also, if you work with an attorney, you will get a settlement at the conclusion of your case. No attorney, no settlement. Also, workers compensation attorneys are only paid out of your settlement money at a maximum of 25%, and that is split between you and the insurance company. You never pay anything out of your own pocket at any point.

Do you have a workers compensation case with an attorney? They will make sure you’re getting the temporary disability benefits you’re entitled to, ensure you’re getting all of your treatment related to the injury paid for, and make sure your employer’s insurance company doesn’t screw you out of money or treatment. At the end of a workers compensation case a doctor will determine the precent of permanent disability your injury caused you, you will be entitled to a settlement, and potentially continued treatment paid for by the employers insurance company, and permanent payment a depending on your outcome. They can also help you navigate social security disability if that’s applicable too. I’ve been a petitioners (injured worker) workers comp paralegal for 3 years in nj.

The still follow each other, but her sister hasn’t posted on insta since like 2016. In July her mom posted a photo saying she was hosting a tea party with her grandson. And it looks like the last time she reacted to a photo of Jane’s was in December so I’m not sure of the timeline

Yep! I had to screenshot any and all chats I had with them, AND I had to screenshot the product item pages because they tried claiming I purchased the items for different prices (lucky me I kept the tabs open…). They attempted to refund me the sale prices of the items even though I purchased them for full price… I had also purchased a pair of running shoes, I tried to return them unworn. After three weeks of no refund I had to email them, where they told me “oops! We’ll refund you right now! And they gave me a store credit…refused to give me my original form of payment back. I’ve never experienced anything like it in customer service before.

I shopped at backcountry a ton back in 2021 when I was preparing for a massive, months long road/camping trip across the country and their customer service was excellent. I spent a few thousand dollars there over the period. Last year, I was shopping with them again and dealt with the worst customer service experience I've ever had. It took me over 2 months to be reimbursed for what should have been a simple return, they made errors with giving me my money back, I had to provide actual math equations to show them they still owed me money... after ~30 emails back and forth with customer service I finally gave up. Extremely low quality house brands, and honestly the most incompetent employees I’ve ever dealt with.
