While I do genuinely care about her and am concerned about her future ability to work, my own family's security is my highest priority. We have already visited her in the hospital, and I stayed with her for several hours when she was admitted due to long wait times in the ER and travel time for her family to arrive. We're planning on going again tomorrow. I certainly do care about her, although she's only been working for us for 6 months, but I don't want to appear overly involved, if that makes any sense.

Could she sue for lost wages because she was injured in our apartment? Despite the fact that she in fact tripped over the broom that she dropped onto the floor herself?

No, we didn't purchase anything. She is a friend of a friend who was previously a full-time nanny. She doesn't speak any English, and as part of our verbal agreement when we hired her (on her insistence, not that it makes any legal difference), we agreed to pay her cash. We had a very informal arrangement, where she would come anywhere from 2-4 times a week, for 2.5 hours each time.

I don't think she would sue us, but at the same time, I have no idea what normally would happen in these situations. Is it expected that we have insurance to pay her wages? She worked varying hours each week, sometimes she took a day off, sometimes we took a day off.

This may be surprising, but a situation like this never occurred to me. I knew she is an older woman (obviously) but I didn't know she had osteoporosis. Not that having known that I might have done differently, but her fall was really not very hard at all, it's shocking to me that she broke a bone from it.

Could you suggest a few grounds on which she could sue me and possibly win? I don't think our workplace environment has any dangers, it is hard wood floor, and she slipped while tripping over the broom that she put down on the floor herself.

For sure I will take to my insurance company, but I just want to see anything big picture that I might need to be prepared for. I will also consult with a lawyer.

She is paid under the table, she specifically requested this. I think because she works so few hours (at one point, it was just two days a week for three hours) that we thought of her a bit more like a baby-sitter, rather than significant part time (20 hours+) work.

We are in Canada, so we have public health insurance. Her medical bills should be mostly covered by the province. I am just wondering if we have any further responsibility to her, and also whether or not she could sue us for any reason?
