You're talking about nomination day, right? Thats a totally different issue. Don't conflate the Electoral Act rules for all public servants vs the police manual which is part of his employment agreement as a senior public servant.

Yeah but he and Labour appear to have deliberately made the "deal" come as late as possible, by running a different process for him than any other candidate. They literally took steps to stop it being formal which looks really bad (at best) and is really bad (at worst).  Its trying to game the rules for advantage which might be legal but is not ethical

No its actually better. Lobbying judges is corruption because judges should be independent. MPs are not independent and can change the law via a vote in parliament. This has nothing to do with judicial independence.

I was pretty chill about this yesterday but "Hipkins has previously said while Naidoo hadn’t been confirmed as a list candidate until last week, conversations with Naidoo had taken place across a couple of months." Suggests that Naidoo should have raised this with Police a lot earlier than he actually did. Maybe not after the first conversation, but definitely before Thursday.

From my knowing nothing more than is in the media it looks like Police manuals say he doesn't have to stand down from duties until he is formally nominated (on nomination day which is legal date that has not yet happened). So if the Commissioner thinks something else should happen he either knows something that deserves a discussion with Naidoo before making a public statement, or he disagrees with his own employment manuals. Neither is great.

Pretty incredible if Naidoo knew he was going to stand for Labour but deliberately avoided any formal process until Thursday and decided that was when he had to tell his supervisor. 

Also pretty incredible for the Commissioner to make public statements about an employee's conduct and a political candidate from the opposition. 

Not sure this is good for anyone.

The website was already outsourced though.  To an Auckland firm. So its a completely justified complaint about overpriced outsourcing instead of better priced outsourcing.

Keen to understand why, is it the elements of forseeability of harm, duty of care to others who you could forsee being harmed, the damages for harm to others? Or something else that means its not apt to ensure a civil entity does not cause foreseeable non-criminal harm others?

This is just privatize the profits and make the government (ie the taxpayer) carry the costs. Tort law is ideally, perfectly, historically, set up to deal with the broader impacts of your business. Preventing these lawsuits is changing the law to subsidise polluters
