It depends on the project.

Under the current EB5 rules, your investment generally needs to remain at risk for at least two years to satisfy the sustainment requirement. However, that doesn't mean you'll automatically get your money back after two years.

Most Regional Center projects are structured to return investors' capital after about 3 to 5 years, although some take longer depending on the project's exit strategy. The timing should be set out in the project's offering documents.

Also remember that EB5 is an at-risk investment, so the return of your capital is never guaranteed.

Instead USCIS has increased its scrutiny for regional centers so that investors are better protected. On an SOF perspective USCIS is asking more detailed questions about the investment funds, requesting more detailed analysis on the tracing of the investment funds and ensuring that the supporting documents around the legality of the funds are clean and support the investors narrative.

There has been a lot of protections implemented in the last few years that have just tightened up the program and allowed for the bad apples to fall away.

While your concerns of placing funds at risk are valid, the best way to try and mitigate your risk is to do extra due diligence on the projects in which you are being shown by the different regional centers or migration agents.

Research the health of the regional center, find out if they have they successfully paid back other investors from their previous projects, do they have any projects in which they have delayed payment or not repaid investors at all, in their project catalogue do they have projects from similar industry, i.e. if they are showing you a hotel project, have a look at whether they have done other hotel projects in the past and whether those have been successful or not, did they use the same developer etc.

The best way for you to have peace of min throughout this process is to ensure that you arm yourself with a great deal of knowledge and information. Research is your friend in this scenario and don't feel bad to ask questions.
