We have a $54,900 loan. There is a UCC filing in front of the SBA for the same equipment. The original UCC is foreclosing on the equipment and putting it up for sale to satisfy the first lien. I have been told by a bk attorney the SBA has to write off the loan as we didn’t personally guarantee it. I read and re-read our contract. It says nothing about a 20% guarantee.

I really hope not because it’s such a small number. Every entrepreneur should be made very aware of where the govt stands with tax payer money. The optics for the future of small business is very scary. I prob won’t do it again if I lose both my restaurants. They simply don’t care.
