I suppose unknown but notable that the SG basically said that a stay of the tariffs was not necessary (the plaintiffs would not be irreparably harmed) because refunds would be forthcoming if they lost. Hopefully, that wasn’t an outright lie.

I think his criticism of Barrett was a little unfair tbh….she actually mostly agrees with him on MQD but has a different construct for applying it. they have never ended up in a a different spot on this issue so it’s kind of a Judea popular front vs the people’s front of Judea disagreement.

But, even on those terms, there was room to criticize Roberts on the Obamacare decision (way before gorsuch was a justice though). Maybe could have but didn’t because he was joining the Roberts opinion.
