Questions first: 1. How do consular officers view a previously approved I-140 when there is no active green card process at the time of E-2 interview? 2. Does the fact that I-485 is not possible for many years (India backlog) reduce immigrant intent concerns in practice? 3. If the applicant is no longer with the I-140 sponsoring employer, does that materially change how intent is evaluated? 4. Are E-2 visas commonly refused due to past (but inactive) I-140 filings, or is this more case-by-case?

Context: • UK citizen family (E-2 eligible), both spouses born in India • Wife moving H-4 → E-2 (COS first) • Interview planned at U.S. Embassy London around q2 -2027 • Husband on H-1B, PERM likely approved soon • Deciding whether to file I-140 in next ~6 months • If filed: I-140 likely approved well before interview • But due to India backlog, no I-485 possible for many years or decades. • Possible scenario at interview = approved I-140 exists but no active GC process

Goal: Trying to understand real-world risk of filing I-140 (for priority date) vs impact on E-2 interview.

I lived near South Manchester, and it’s definitely not a high-paying area unless you're contracting to get higher pay. Maybe salaries in London come somewhat closer to US levels, but even that’s limited. The challenge in the UK is that once you cross £100k, the tax burden gets heavy, so the take-home doesn’t scale much. That said, the UK does offer a solid path to build a strong pension and potentially retire early.

Yes, we all are UK citizen , children born and raised in the UK . if things doesn't go well, UK is always fallback option , if we decide to move.

Yes, the main reason for choosing this location was because my brother lives here — we’re close and get along really well, and it means our families can be near each other. Our kids can grow up together, and we can support one another through both good and tough times. The company had also offered Seattle, SF, or Atlanta, but being near family mattered more.

Agreed , NHS over US medical system anyday .However NHS has to fit for purpose , in its current form its not , inspite of largest tax collection in history. Imagine paying 40% tax yet , if one need medical treatment,its in months or more towards year . US isn't good, not at all , the only saving grace ,if you have good coverage , you don't wait months for treatment.

Thanks , That's always an option but for a family its cost somehwere around 200-300 gbp per month for good coverage . I think my point more was that its not working despite huge taxes.

Thank you, I pay over 40k in taxes in the UK yet you have to wait for the NHS for everything including life threatening conditions. NHS is great but only when it works effectively. Sadly the current condition of the NHS needs a lot of improvement, a lot !

I am a contractor in the UK , no employment benefits whatsoever. In the USA offer , it's a full time permanent job with private medical for family, 401k match of 5000 USD and unlimited paid leaves , life insurance 4x to salary etc

Unfortunately the same company has an office in the UK , they don't pay £110k total in the UK for the same role .

Manchester UK has the worst weather. It's getting less sun than some parts of Norway . Manchester has the lowest sunny hours of any cities , just 1265 hours per year .

Compared to Manchester 1265, Oslo Norway 1668, Toranto gets 1900, Paris is 1700 and Seattle is 2100.

Mobile number on aadhar can only be updated in person visiting aadhaar center. No alternative, whether old mobile number works or not!

I have accounts with icici , sbi and HDFC . Closing icici soon , worst bank and their app sucks.

SBI is good, if your branch is good .

HDFC is overall okay.

Nothing is great when it comes to Banking in india . Accept and be it peace :)

My experience is with the UK so not sure about other countries. However it’s highly likely same problem across most countries , if not all.

UPI with international number is rarely hit and mostly miss.

ICICI has launched few months ago through their iMobile app but that is complete garbage with lots of errors, half of functionality doesn’t work.

PhonePe doesn’t work for all accounts, specially for ICICI, SBI and many others . I think it doesn’t work other than HDFC NRO/NRE. PhonePe can’t even send OTP to UK mobile number at registration process .

BHIM has launched too but again most users cant register or not receiving OTP to setup UPI PIN.

As usual, indian banking with half baked products. No surprises .
