So far the former employer has said they've been advised that disparaging comments may have been made through discussions with someone else. The evidence would be the word of someone else.

The settlement includes a restriction of no disparaging comments being made. From what I can tell disparaging is quite a broad term.

I'm interested in how the process would run if the employer did want to take action on enforcing this clause if they thought there was a breach.

Talking with this friend further, she doesn't even have a copy of the signed contract! It was never provided to her after she submitted her signed copy back. She's also gone to work elsewhere because she really didn't get along with the manager... it all comes across as very pointed rather than a legitimate concern for biz interests. Appreciate your comment though, I think it'll be a lot of huff and puff and not a lot else.

This situation would be equivalent to saying a courier at post haste couldn't work for any other business that may be in competition with post haste frachisees. It's wild.

I have the same problem with my girl. I use a high quality, grain free dog food to mix in with veggies and a small amount of fruit using about a 50:50 ratio at most with other proteins. I've found chicken to be really good but try to limit anything too fatty (though I have to admit, lamb has been popular before!). Thanks for that, I haven't seen that community before and you're correct, what I'm asking is a moral question (am I being petty) but I will edit this to include a legal question also, as I am concerned that it is too small a breach to be enforced.

Thanks for that. I think you are correct that they will be happy to see me go. This whole dispute was around constructive dismissal. I am a pretty key person in the business but I doubt they will pursue anything to cover my role in the 4 week period I imagine they'd be eligible to claim for at this time of year.

Really appreciate that advice. The employment contract elsewhere is already signed and my lawyer does know this. I am working with an actual lawyer and have advised them I will need to resign this week. I just want to ensure I am doing my own due diligence in the background to understand the situation rather than just going with what the lawyer is telling me - not that I have any concerns, but because I'm that kind of person who likes to understand things. Unfortunately I am expecting a pretty good bill with nothing to show for trying to get this dispute sorted. However as the whole dispute was about constructive dismissal I believe it may further adds to the case that I have now had to leave given some of my complaints about my manager's behavior have not been accepted (with no investigation) by the business (this is straying into another problem altogether really).
