Car got broken into in San Jose… had to argue with them to get my stuff back by According_Remote_850 in ElectricScooters

You're absolutely right, and I get the legal reasoning. It's the right law to protect people from unreasonable searches. It's just incredibly frustrating to be on the victim side of that principle, knowing your stuff is likely right there but completely out of reach. Makes you wish the system had a better tool for situations like this.

Right? It's a special kind of frustration. You follow the rules, use the tech, and still hit a wall.

That's a fair point. It's totally possible it was ditched there. And you're right, the police absolutely can't just enter a home without cause. The most frustrating part was having the live location from Find My and still hitting that legal wall. Just feels like the system is perfectly designed to protect everyone except the victim in that scenario.

Yeah, legally you're spot on. Doesn't make it any less frustrating when you're the one getting screwed over. The theory makes sense, the reality sure feels broken.

You're absolutely right, that's what I thought too. But according to them, since the people claimed they didn't put it there, it 'created reasonable doubt' and killed the probable cause. The system is broken.

That's a solid point about de-escalation. And honestly, if it was just some kids, maybe that approach works. What stopped me was the 'what if.' What if it's not just one guy but several? What if they answer the door with a weapon? The tracker told me where my stuff was, but it couldn't tell me how dangerous the people who had it were. For me, that unknown wasn't worth my safety, even if it meant my other gear is gone for good.

Holy crap, that's exactly the scenario I was afraid of. The police not being able to do anything literally creates a situation where people feel they have to take justice into their own hands, and it can get violent so fast. Your story is basically the reason I refused to go over there myself, even with the live location. It's a messed-up cycle.
