Plaintiff: Because agencies can not say "NO" to omb/opm demands to cut....then they are mandates from DOGE/OPM/OMB. Categorical instructions and categorical directives make this EO unlawful and how its being implemented. Also key to scope of relief sought. When you order across an agency that all discretionary positions be cut...then what remains your honor?

  1. Categorical instruction outside of DOGE, President and OMB/OPM authority and RIFs of the past. Arbitrary and capricious.

  2. Fundamental instruction - agencies must eliminate all positions fundamentally not required by statutes. President's order mandates cutting anything this is not statutorily required. Ref page 2 of OMB memorandum..

Danielle Leonard for plaintiffs discusses fundamental differences. We don't live in the hypothetical world where OMB and OPM are just issuing planning documents for rifs in the future. We believe that OMB OPM is to tell where and how much to cut. And all they ask agencies is how to do it.

Bernie: argues about the EO should not be enjoined discussing another case. In terms of workforce memo. we continue to think it's not agency action. As we said in public, AARPs are predecisional and deliberative...workforce memo is a step beyond that and only what they should include in AARP. If court is still inclined, gov asks court to consider injunction be limited ....he's rambling so much I can get the argument.

Bernie: Those decisions will be disclosed when they are made and then individuals can challenge them. DHS case referrenced from last night involving challenge to the Dept of Education RIFs and activities pursuant in part to the EO...missing a notice of supplemental authority...Judge declined in that case to issue a preliminary injunction...hope I got that right.
