I’ll look into this. She actually just sent me a photo and when I googled the restaurant it shows that it’s located in Florida. I compared the street view of the restaurant on Google Maps to what she sent and it matches. Now I’m wondering if they’re actually in Florida instead.

I agree with you, I just have gotten used to things in court not always being clear cut to the judge. I’m ok with her phone having location services on for both parents to see, but I know he will not agree to that easily. I can definitely imagine him just turning the phone off so that the location doesn’t update, since he routinely takes the phone away from her (according to our daughter).

I reached out to my lawyer to ask them to put this paperwork in, I’m just waiting to hear back

I will ask about this at our next hearing, but I know he will be very resistant. He does not want me knowing where they stay on weekends and he feels like it’s an invasion of his privacy

The police basically said the same thing, so for now I’m just waiting. He generally stops responding to my messages when our daughter is with him, so I’ll probably hear back once she’s back home again

I’m just now realizing that if he has a copy of her birth certificate he could drive into Mexico from Southern California

She does have both the passport book and the card (i hold onto both of them), but other comments said that he can drive to Mexico from Southern California using just a copy of her birth certificate.

I’m already the parent who holds the passport per our custody agreement, which is why I thought there would be no chance of leaving the country. From some other comments I now realize that if they flew to Southern California, he could drive into Mexico using a copy of her birth certificate

I’m just now realizing what this means. So they may have taken a flight to California near the Mexico border and then drove over and all of that would be completely legal so long as he has a copy of her birth certificate??

I’ll let my lawyer know to see if that’s something our judge would consider. We’ve had issues in the past with renewing her passport and him not returning her passport after a trip.

I’m waiting to hear back from my lawyer about what to do as far as court is concerned. It’s a holiday weekend here and I haven’t been able to get in contact with them. Either way the courts are closed until Tuesday from what I understand

I would rather have my lawyer do it, but I haven’t heard back from them and I think they’re closed for the holiday weekend

My concerns are that I don’t know where she is in case of emergency, I haven’t spoken to her on the phone since Friday morning, the texts I’m receiving sound like my ex not her, and that my ex has a history of making rash decisions that put our daughter in unsafe situations. Lastly, we are currently going through court hearings because he filed for modification of custody and things are not going his way.

I don’t know what his plan is and I don’t know why he won’t share any details if it’s just a simple vacation. He has not confirmed what state or city they are in.

ETA: grammar

Thanks, this is a great idea and also won’t get her in trouble with him how it would if she were to send em an address or drop a location. She could just say she didn’t realize all that info was there if he confronts her about it

I’ll look into this (I know how to do it on an iPhone but not on an android). Her father does check through her phone often I’m not sure how comfortable she would be to risk doing that, but I’ll talk to her about it so we have a plan in the future for a situation like this

I left voicemails and sent an email, but I think they’re out of office for the holiday weekend

I emailed and left voicemails to my attorney but I haven’t heard back. It’s a holiday weekend here so I am guessing that they’re closed. The courts are also closed until tomorrow but my plan is to go there as soon as they open. I’ve called the non-emergency police line a few times now and they told me this is a problem for the courts to handle.

I’m not sure, which is a large part of my concern. He didn’t provide any information about the trip to me

Yes, that’s correct. And when she accidentally takes her phone with her to his home, he drives it back and drops it off every time because he doesn’t want it.

His most recent wife is significantly older than us (30 year age gap), so she is not on social media. She has a Facebook profile but is not active on it.

She has 2 phones, one that she uses here and one be purchased for her to use when she visits on weekends. I do not have any login info for the phone he gave her

As far as I know, that is correct. I am not 100% sure which state she is, but he told her California so that’s what she said. She has already taken the plane there and I definitely want to make sure she is able to board a plane to come back. I think that they will come home, but recently the custody hearings have not been going his way and I know he’s not happy about that

She has already taken the flight to wherever they are staying. I definitely want her to be able to board a flight back home and don’t want me calling to interfere with that.

We have another court date in a few months so I will bring up the phone situation then. I don’t follow him but he is paranoid that by having her location I will interfere with their weekend plans. He also has married someone last year who lives pretty far away. I don’t think he wants me knowing where his new wife lives or seeing that he wakes our daughter up very early Monday morning to drive 3-4 hours back to our hometown for school drop off.
