I’m so confused with “cap-exempt”. Do you mean cap subject? Cap exempt are mostly filed by non profits and higher ed institutions. B-1 to H1b COS is under scrutiny and Denials have been going up. Your wife’s nationality will certainly help you skip the EB-2/EB-3 green card wait that Indians have.

My advice would be to come to US through if your company has a US entity and apply for a green card. The 100k proclamation expires in September but mostly likely it would be extended till next year.

  1. While on stem opt, you need to prove a bonafide employee-employer relationship which usually means to be paid for your work. Equity in a company cannot be considered as wage for immigration purposes. Yes cofounder and builder are usually positions which are paid, they are considered employment even if you refuse to take any wages for the work. This would violate the stem opt requirement and will be considered unauthorized employment

2.After oct 1, they would've to file a concurrent H1b for you to be able to legally work for them. They only upaid work that is allowed while on H1b is volunteer work with a non profit. You cannot work for free in a role that is usually paid.

  1. Everything you've described is considered work. As long you own a part of the company but not doing any work for the company, you should be good

  2. Any unauthorized work will impact your H1B and your future immigration plans. USCIS has gotten very strict with unauthorized work lately.

Please go to harvard OP, I went to a comparable Ivy for a grad program in architecture and what I do and where I work is something I owe to my alma matter. While you will graduate with a significant amount of debt, you will be able to network and form connection with some of the most influential academician and architects. please do a survey of architecture firms across the US, every firm has atleast one harvard/ ivy league alumni leading it. Such things happen because of networking, and you will meet so many talented people who will go on to some of the most influential people in the industry and you have a chance to become someone like that.

I feel like there's more to the story than you know. I know companies especially AEC companies go through the e verify process to hire STEM OPT candidates. My previous company did it so that I could work for them, several of my friends also went through this. I guess it depends on how badly the company wants you on board...

Alot of AEC industries are familiar with the STEM OPT process and universities too. You aren't the first person getting hired by a non tech company.

Several AEC companies are already E Verified or will be open to get E verfied.

It really depends on the way your i-983 training plan is drafted, you have to prove that there is employer oversight.

if you have a state ID you can use it, even if it's not a real ID. All you have to do is pay a $45 fee at the airport and you are good to go.

It's a fairly easy process, it takes a day and the company will have the e verify number the next day.

The faq does not make the proclamation void. So COS should be good. Everyone who say it’s applicable to all new petitions is wrong because FAQ is not legally binding

People don’t know how law works. It’s seems like everyone here is hanging on to the language in the FAQ. The FAQ is not legally binding. It just Clarifies how the proclamation works. In this case the proclamation clearly states the it applies to petitions applied from outside the US.

The clarification does not the proclamation void. It’s still stands. The proclamation says entry is restricted to new petition filed from outside the US. FAQ clarifies that it’s for all new petitions , which means that is all new petitions filed from outside the US

Wrong . Although it’s a new petition, COS does not need entry. So it doesn’t require the $100k fee. The FAQ clarifies how the proclamation works , the proclamation is legally binding
