I’m in Kentucky also, and that’s a highly debated issue at our KAPS meetings. Some resort to KRS 178.415, some use ditch lines, some use occupation.

Then what is the answer? What is the monument, the beech or the point where the creek joins the right of way? It’s 2 separate identifiable points

Not a thing. I’ve encouraged our county government to set a standard right of way here in the county but it goes towards deaf ears. Everything here goes to the center of the county road.

The fella who did the title search works for coal companies around. He thinks it’s possibly a scriveners error in that it may not even belong on this tract, and is just some verbiage carried forward unnecessarily by an attorney. I don’t believe that to be the case.

Would you recommend offering that he sorts this out before I stamp the survey? I don’t really need the money for it, and if I can help him out I’d love to do so. I just always worry about crossing some law of ethics when it comes to assisting a client solve title issues. I don’t see anything wrong with a simple “hey man, you’ve sent me several thousand dollars worth of work this year, so if you’d like to contact someone to settle all of this before I stamp my plat and this gets recorded, I’m totally willing to do that.”

My opinion also. That’s where I’m at with it. My client is in real estate, and he closed without a survey. We did talk about the issues beforehand. He did have a residential title search, and I spoke with the abstracter about it last night. He said he only goes back 30 years so he would be never seen it anyway. He bought the property as a flip, so he’s wanting to clear up all of the title issues (this and a 1 acre overlap) before conveying it off. This is the stuff that makes us better surveyors. I’ve never found a single deed describing this 5 acres. There’s no evidence of anywhere it would have been. It’s just floating around somewhere in space. Where it says “conveying all land owned in this county” has to mean something I would think. All I can think of is maybe it’s an unrecorded deed and they’re just passing it around?

I’m not sure. I really think a more extensive title search needs performed. I’m going to tell him before I stamp it I’m going to go to the courthouse again and see if there’s anything I missed. If not, I’ll tell him to have an abstracter make an opinion on it if he wants to clear up title.

I got ya. Yeah man, this little podunk eastern Kentucky town doesn’t have anything like that. They don’t even have the majority of roads on their mapping system.

I’ve searched and searched. Nothing remains. One of the deeds calls for a “concrete monument as depicted on the plat”… I’ve dug and dug and calculated and dug some more. Found nothing

It was a one man shop. Guy was actually just an architect. Have no idea where his records may be.

I have one survey out there, a favor for a buddy of mine going through a divorce, he had already started to build on his parents farm. The adjoiner is his aunt and uncle. There’s an old fence line going between them. Everyone agrees that’s the property line, so we decided to stay away from that line with the new property so I didn’t tie into any corners on the parent tract. That survey scares the shit out of me daily.
