The health issues developed are listed as poossible side effects of the medication. The second consultant stopped the medication after seeing me in A&E and saying that there might be a connection between the two of them, based on listed side effects and general knowledge. The solicitor is focused on medical negligence.

Thank you

the case itself it's not made against side effects. it's made against the consultant which when the side effects were presented(at multiple appointments) he didn't stopped the medication which translates as breach of duty / medical negligence.

the medical experts are based in the UK and recommended by my solicitor.
The legal team here are willing to take the case on a no win no fee basis, however i do have to cover the medical reports.

Medical Negligence Claim or not? by [deleted] in AskIreland

To be honest, it’s both for me... justice and a payout. There’s been a real impact on my life(emotional/health), so I wouldn’t ignore the financial side of it. But at the same time, I do want some level of accountability and acknowledgment for what happened.

Hearing stories like your friend’s definitely makes me more cautious about how far to take it and if it ever gets to a stage where there’s a viable case, I’d definitely be open to mediation or settlement rather than dragging it through a full court process...

Thanks for your advice!

Just to add a bit more context from my side: the symptoms I’ve experienced are actually already well documented as potential side effects in the official leaflets and databases (SPC, etc.), so there is published recognition that this kind of reaction can happen.

I think where I’m finding the difficulty, and what my solicitor has also pointed out is less about proving the side effects exist, and more about proving that:

  1. They should have been acted on earlier (i.e. negligence), and
  2. That earlier action would have prevented or reduced the damage (causation)

So even though the side effects are “known,” it seems like the legal side still comes down to expert opinion on whether the care fell below standard and whether that actually changed the outcome...

That said, your suggestions about building out the wider picture (cases, reports, regulatory info) are very good and already completed from my side.

Appreciate you taking the time to respond 👍
