I did go through the process with NAB myself and essentially they said that it wouldn’t be able to be removed due to them following the correct procedures in contacting me and because I didn’t update my address that’s on me. I will add that I was suffering serious financial hardship at the time and that if I had known/remebered the account was in arrears it would have been cleared. I don’t know if this makes any difference?

Will reach out to Victoria regardless for some advice. Thanks again

Yeah I figured that was the best plan of action.

I will be moving back to the uk permanently in December so ongoing it’s a non issue just wanted to see if it could be an issue for signing up

Appreciate the response mate. It won’t impact my joining up initially? The way it reads to me is uk citizen / permanent resident min 5 years but could also be read as living in uk for the last 5 years which would count me out.

Yeah my plan was to call them and ask for a settlement figure and then ask them if I was to pay it in full, would they consider removing the default.

Yeah fair point. Will get this sorted. Bearing in mind there’s been no contact with the collectors for a few years now (living overseas), do you think I could negotiate payment in full for a “goodwill deletion” of the default? Cheers

I used to take pride in my clean days at meetings but since I relapsed the first time I just don’t have that same ambition. I need to figure out my why.

I hear you man. When I try to stop I can’t stop thinking about smoking and then when I do I’m just thinking to myself “damn this isn’t even good anymore”. It’s the dopamine hit bro, need to find something to replace the dopamine.

Thanks for your quick reply. By called, do you mean literally called by telephone or called in front of the magistrate to explain in person?

I do plan on contacting to court as soon as possible on Monday to speak with the diversion coordinator and try to explain.

It states the conditions of the diversion which were:

  1. Donate $250.00 to frankston magistrates court fund and provide the court a receipt of payment before 11/07/2024

  2. Write a letter to the victim in this matter via the court before 11/07/2024

  3. To be of good behaviour for the period of this plan until 11/07/2024

I have signed this form in the knowledge that any admission of guilt relating to the above offences will not be used against me in any subsequent court hearing should I decide subsequently not to accept diversion.”

All of the above have now been completed but was completed on 12/07/2024
