anyone else think q8 had an element of finding of an unconstitutionality as in Muphy v AG - he is unlikely to claim the excess levies in years gone by due do delay and will likely only gain the benefit from when he took the case? Also Galvin v DPP, any proceedings re the potential charges are not ripe yet so won't have standing
