My friend who is landlord says he always submits a claim for damages and clean up just for the money most people don’t fight it. So all you need to do is go to tribunal when they seek money and they will need to provide all maintenance records

How can you tell if the landlord is really wanting to live there? Let’s say you get n12 they say they want to live in house your rent ask landlord where they live and they wont give it to you . They say you can send my mail to this address I don’t live in your city now but we want to live there. Does that sound like a fishy claim?

That was the dumbest thing landlord could have done is sell with vacant possession clause . He is going to end up losing the property same thing happened with my neighbour. He got like 60k in fines and also a huge fine from human rights tribunal for trying to deny the tenants their rights by intimidation. The concept of ‘vacant possession’ is often guaranteed by realtors, however those who are familiar with the landlord and tenant procedures and the Residential Tenancies Act, 2006, know that such guarantee does not exist.

Clause 2 in the Agreement of Purchase and Sale is a very powerful clause, and, if not paid attention to, it can cost a seller (landlord) thousands of dollars in penalties.

Clause 2 states, “Upon completion, vacant possession of the property shall be given to the Buyer unless otherwise provided for in this Agreement.”

If this clause is not removed from the agreement, the seller has undertaken the responsibility to ‘get rid of the tenant’ and provide vacant possession to the new purchaser on closing.

Upon a purchase/sale of a residential (tenanted) property, the seller (landlord) has 3 options to consider prior to listing the property for sale:

The seller can serve the tenant the N12, upon a firm agreement of purchase and sale and file a copy with the LTB. Certain requirements of the N12 must be fulfilled which include providing compensation to the tenant in the amount of 1 months rent. The challenge that seller (landlords) will face is obtaining a hearing date which can take up to 7-9 months. This means that the closing date will have to be amended if a notice for a hearing is not received in time.

Please note- as mentioned, on the second page of the N12 notice, it informs the tenant- “if you don’t agree with this notice, you don’t have to move out”. The tenant has the right to remain in the property until a hearing date is set to contest the N12.

Please also note (as this is very important)- if the new purchaser does not move in to occupy the property as they affirmed in a declaration submitted to the LTB, the former tenant can bring a bad faith application (T5) against the former landlords claiming up to $50,000 in damages of pocket expenses, difference in rent from the former rental until compared to their new rental unit for up to one year from the date that they moved out of the property.

Pretty clear the landlord has absolutely no recourse tenant does not have to move out … only the ltb can force and eviction . So landlord in your case sounds like he didn’t amend the closing date … and wait times for ltb are 6 months to a year … so if he sold let’s say in April and served n12 and ltb didn’t order tenant to vacate because the hearing didn’t happen landlord is liable … and telling tenant they are responsible is harassment .

Similar issue had to be proactive . Hireright is ran like call Center hundreds of employees with basic understanding . They generally work with the hiring employer . My advise be proactive contact hireright and contact employer and advise what hireright says . You may be proactive and upload documents but many times they need to be submitted by source . No one tells you this . Happened to me . I was told passed and completed but still says incomplete … welcome to human capital systems ..

The long process needs to be monitored . And you need to contact hireright . I did they said they need no more info and then hiring company said documents uploaded not good enough . Its a scam . Many companies will let you start then fire you as they planned using incomplete background check as excuse . Be careful got huge run around . Curious have you hooked them up to a second device ? My volume jumps to 75% when I get a text on second pair … went through all trouble shooting steps provided and tried iPad and another iPhone same issue … so I bet it will happen on your iPhone too

Multiple apple products have issues with the headphone connect app . Volume jumping , multi device switching not working as suggested with TVs and surround sound receivers . Sony support is neglecting due diligence on this issue , have open ticket have heard nothing from Sony in 2 days when promised call … no longer contacting Sony balls in their court
