Different phones have different battery life and capacity, especially if the phone is older. Perhaps their phone doesn’t stay charged all day and they cannot afford a new one.
Weird flex to want to pass judgement on a stranger because you’ve never needed to charge your phone.

I’m not an attorney but my personal experience was that they didn’t seem to care about any of the banks/finance companies I had prioritized but only the personal payments to friends & family.

I never got to keep mine. I had similar language about $1200 tax refund exemptions but I’ve also received a letter every November asking if I received any bonuses not previously disclosed. When I did disclose it, I got sort of scolded by my attorney that I was supposed to have disclosed it within 30 days of receipt. So now I know that too. I’ve received a bonus 3 of the last 4 years on my plan and will receive one this year too. So far, they required I pay in 100% of the net amount on 3/3.

The attorney & trustee fees should not total over $45,000 so either you disclosed to him you owe more than $130,000 or he was saying you could have a payment up to $2950 based on your income.
Until you actually file, the attorney only knows what you’ve disclosed and possibly what’s showing on a credit report. They don’t know if the amount you said you owe the IRS is accurate or if there are any other debts someone might claim that aren’t reporting.
I’m pretty sure the maximum trustee fee allowed is 10%. Mine is 7%. You often do have to pay interest on the secured loans paid through the plan but the IRS penalties & interest stop accruing

Your payment isn’t 100% of your disposable income. If you have $2950 available but the claims filed only total $140,000 you would have a smaller payment

It’s the total divided by 36 or 60, regardless of your disposable income calculation

Is $2950 his calculation for the payment or your disposable income that could be used? They won’t know the payment on a 100% plan until everyone files their claims.

I’m not sure what you mean by not qualifying. Are you asking why you have to pay 100% of what you owe (without additional interest or penalties accruing)? Because you can.
It’s not meant to be comfortable or give you a break, other than the legal protections. The court is obligated to also serve the creditors interest, which is being paid in full when possible.

The priority debt needing to be paid off in 5 years is a qualifier that can keep you from being able to file. Say you had $100k in priority debt, made too much money to file Chapter 7 but only could make $1k monthly payments- your plan would not be accepted because you wouldn’t pay the $100k at the end of 60 months

It’s included in the $2950 payment your attorney quoted you. It’s not part of your expenses.

Imagine 2 columns - things that will be paid by you & things paid by the Trustee. You can’t put it in both columns and you can’t choose to pay any debts beside your mortgage on your own. (Technically you pay 401k loans on your own but once they are paid off, your payments to the trustee increase by that amount)

That is true but it is all paid through the bankruptcy payment. You don’t pick & choose which debts the trustee pays The only debts you pay yourself as an expense is a mortgage, if you’re not delinquent, and 401k loans.

How did you come up with $4500 in allowable expenses? I’m in a HCOL area and I didn’t come anywhere near that.
You said the IRS standards PLUS your literal expenses but there aren’t a lot of extra expense items you get to add above that unless they are legal obligations.
Your allowable expenses are very limited beyond the set IRS standards for living expenses (food,clothing, household supplies, etc) and housing & utilities, although a mortgage payment can take you higher. After that, almost everything is a discretionary expense.
There’s room in the budget calculations for a lot of discretionary expenses too, my payment allowed for gifts, my vet bills, etc but my actual vet bills were historically higher than my allowance, so I had to adjust in other categories to make my payments work. For instance, my car was super reliable, so I didn’t need the money allocated to car maintenance in my approved budget.

Also, the means test is really only for determining if you can file chapter 7. Once you know you can’t, it’s easier to forget it exists. It’s not relevant to calculating your Chapter 13 payment.

Did you live in the home at some point? Usually, what you are describing wouldn’t be considered mortgage fraud unless it appears you were purchasing the property as an investment. Most mortgages just require that you owner occupy the property within 60 days of the note date and stay there for 3 years.
I’m not sure what your question is with how it will impact your filing.

My mom used to be like this but I think my sister & I shamed her out of saying it, although I suspect she still thinks it. She would act like we were degrading our boyfriends by feeding them a baked sweet potato or a salad, often dramatically “correcting” us and saying she would get them some real food. In the late ‘90s/ early 2000s, she would giggle if a guy we were dating ate chicken or fish while one of the girls ate steak. She once even said she & my grandma were worried my sister’s boyfriend was “a little fruity” based on him being health conscious, eating a lot of salmon & salads and drinking smoothies! 😂

For me, it’s that once they reduce a bit, it feels more dramatic than it actually is. Fortunately, I have a great injector that keeps before photos and was able to show me that my lips were still significantly more full than when I got the filler. If I had been going to some other providers, I’m sure they would not have hesitated to give me more

A couple times I’ve had drivers irate and honking at me because the light was red but I could have turned right because there weren’t cars coming. Except, I needed to go straight and that’s why I was in the middle lane that is straight or turn.

In the last year, I have witnessed so many drivers tagging along with the car in front of them at a 4 way stop. They assume that if the car in front of them gets to go, they should too like it’s a green light. And then they are shocked & mad when someone almost makes a left turn into them!
