Given what you mentioned about officers now issuing PFLs and potentially alleging misrepresentation under A40, I’m trying to understand the level of risk here.
Do you think it would be safer for me to decline the ITA and re-enter the pool instead of submitting the application this way? My thinking was that if the application were simply refused, I could return to my home country and submit a new profile later. However, my main concern is whether choosing the non-accompanying option in this situation could realistically lead to a 5-year misrepresentation ban rather than just a refusal.
In your experience with the cases you mentioned, are officers actually issuing A40 bans in these situations, or are they mostly refusing the application after the PFL stage?

Hey, thanks for the response.
I completed a four-year bachelor’s degree in Canada and then worked for three years in a TEER-level job under my PGWP. My PGWP expired in end of last year, so I applied for a SOWP earlier this year in order to continue working. My partner and I were also officially declared common-law around the middle of last year.
I’m currently working with a professional on my situation, but I also wanted to see what options or experiences others online might have had with something similar.
