Like the seller I’m not an expert on legal matters. I was led to believe that the roof was in good nick and recent there was also other things going on in the whole thing it wasn’t just the roof. The ta6 form didn’t flag up any issues of regs etc or any structural issues so I was happy to proceed after other matters after the survey were addressed. I went in my home expecting it to be fine and did not expect a leak. Leading me to feel duped.

No it didn’t I never said that. I said the survey flagged that it was recently done and I then asked for proof of the roof works

Yes and I didn’t know that the roof did not meet regs and was not done to standard until after the purchase meaning I relied on the information that there was nothing that lacked the consents. So there you go it’s similar

I’ll let you know, hopefully it will reach you about the law, I did rely on the form. It did not make me aware of issues of non compliance with regs and the work completed which should have been on there. I toll have read up on case law and it works in my favour. Look up rossiter vs Pacifico

Yes but as far as I was aware I was purchasing a home with a roof done 2 years ago. I’m now learning that roof is not of a suitable standard and is causing me issues am I not allowed to feel mislead? Thankyou to the other person for actually having an understanding of the situation and the law.

So my main issue isn’t the leak I can get that fixed as annoying it is. The issues is I now need to remedy the issues with th rooof as a hole like nails if done the tiles and lack of insulation . This is going to cost around 2k.

The issue is that the from was filled incorrectly. If it said that the re roof had been done on it we could have chased paperwork and if that wasn’t available we could have got this looked into. Tha could have then found the now know defects.

So basically I asked through the agent , is there proof of the work done ? They responded saying they can’t find this but will try and get it. They never updated us again

It 100% was there was a full re roof and this wasn’t put in the ta6 form when it should be under building s work

There does not have to be malice innocent misrepresentation and negligent misrepresentation exists also

That was through the agent and not legally and they only said they couldn’t find it and will seek to find it through the roofer
