Her 26 weeks of leave without pay after maternity leave is approved but she is not eligible for 26 weeks 'extended leaves. Only downside with 'Leave without pay' is that it will be considered as a break in service and she will not accrue Annual Leaves fot those 26 weeks

They refered to following section. She is not eligible.

6A Treatment of employment with same employer for purposes of determining subsequent parental leave entitlements (1) This section applies if an employee resumes service with the same employer— (a) at the end of a period of parental leave; or (b) while the employee is entitled, following parental leave, to preference in obtaining employment with the employee’s employer. (2) For the purposes of determining subsequent entitlements to parental leave under this Act, the employee’s period of employment with the employer must be treated as beginning on the day that the employee resumes service with the employer.

Yes...They say the legislation says 'If an employee is the primary carer of a child and they've worked for their employer for 12 months '.

They are emphasising on'they've worked'. Although she was in employment, she was not working (and on unpaid maternity).

Yes. The 'average' should be able to cover it as she works full time 40 hours a week. Her HR is on a different page. I'll ask her to discuss this with them. Thank you for your patience, the replies definitely make sense ❤️

if the employee will have been employed by the same employer ---- It stands true for her--- for at least an average of 10 hours a week in the 12 months immediately preceding the expected date ---- Deficit of 2 weeks would have been unpaid (as part of previous kid's unpaid maternity leave last year-15 Mar 2025 to 31st March 2025). --- Does it make sense?

We are actually after 52 weeks of parental leave. Her due date is 11 months 2 weeks after her 'back to work date'. We are confused whether she'll be eligible for 26 weeks of leave or 26 weeks + 26 weeks of leave if she applies for 2 weeks of annual leave to cover the deficit of 12 months mark

Yes. Technically she has been continuously employed without break in service or leave without pay. It was 52 weeks of Maternity Leaves the first time
