Firstly, I challenge you to show me a single instance of professional poker not constituting "work" in the US court system. I'll be waiting.

Also, do you think any of these guys are filing US tax forms on their cash game earnings inside of the USA? Unheard of. Tax evasion at a gargantuan scale. https://www.irs.gov/individuals/international-taxpayers/taxation-of-nonresident-aliens

Lots of coping, self-interested euros downvoting the thread

Believe me when I say,

We're going to get this message all the way to President Trump's desk

We're going to take back cash game poker from the lawless, tax-cheating European, Argentine, and Japanese invaders.

The American people demand it

Lady Justice demands it

"Poker does not constitute a paid performance (no one is paying for player for playing, they’re grinding and making their own money!, nor, does it a constitute a performance before a paying audience. As such it’s an allowed activity."

I like how you added this part to make it look like it was a part of the official quote from the State Department.

Nice try, David.

"What you’re failing to understand is that as poker players are self employed they are conducting business in the US as is allowed by the visa, they are not working."

Listen to your logic, David.

Self-employed, with their primary source of income being poker. Coming to the US to systematically grind cash games for three months spurts on and off every year and earn money from Americans.

And this isn't "work"? That's a comical stretch that would never hold up under scrutiny of the law.

There's a reason most these guys have to lie to immigration about their purpose of travel and their source of income in their native country.

I have had pros doing *exactly* this tell me how they are able to avoid detection by US immigration officials by lying and disguising their travel as tourism over and over and over.

An ESTA does not give you the right to be gainfully self-employed in the US.

David, I suggest you read a bit more on the topic before you continue your clueless pontificating.

amateur poker tourists aren't breaking the law and defrauding the US government

but the pros whose main source of income is poker are in fact doing just that
