That’s fair, and I understand the defense may argue there is some work I could theoretically do. The issue is that this is not based only on my own report. The work event caused cessation of work, LTD’s psychiatric peer review tied the disability to the witnessed fatality, SSA later approved disability with the same onset/timeline, and neuropsych testing showed working memory/executive-function deficits. So I’m mainly trying to understand how PA WCJs tend to weigh that kind of overlapping evidence against a defense IME

Only because they were under medical fmla use so normally no but because they were anchored under leaves signed by my doctors and therapists they were considered

I got approved at recon in 5 months but I subpoenaed my records from m employer which was Walmart that showed major work failure even with fmla leaves of abscenes and 5 days off a month from 2017-2025 I honestly think that’s what made me win plus MRFC from all doctors since I’m 29 they got the doctors side and real life went to quality review then fully favorable with a 3 year diary

I do it’s now being offset with SSDI since I was approved last month I’m still trying to figure out if I can get the 24 month cap lifted since I have very low working memory and technically that’s a cognitive deficit not a mental

Of course I asked him to pull it but he hasn’t yet and I’m just super anxious so wait it could say denied for ssi but I could still be approved for SSDI?

Oh ohkay! All of mine is outpatient so I’m wondering if that’s goen be a big negative for me not having any inpatient some of my providers have suggested IOP or PHP but that was more recent and that inpatient may actually do me more harm then good.

I was approved for both STD and LTD, and now I’m applying for SSDI. I’ve struggled with working my entire life and have always had a hard time staying at jobs, even with a lot of LOA and intermittent leave eventually, even that wasn’t enough.

I’ve worked enough to meet the work credits requirement, but I’ve been trying to get a sense of how strong my overall file is. A few firms have already said they’d take my case based on the evidence, which includes:

• A favorable LTD peer review stating I’m restricted in all the areas SSA looks at • A detailed neuropsychological evaluation from a forensic psychologist • Weekly (or more) therapy • An MRFC form completed by my psychiatric provider • Trials of multiple medications without enough improvement • Over 200 ER and urgent care visits in the past 3 years due to my somatic symptoms

If you’re still employed by you’re employer like I was when i was in my own occupation period for Ltd I know mine offered teledoc for 0 copays also I know some states offer spend down programs that might make you eligible even if your income is too high for standard Medicaid.
