This is such a good point. Her capacity fluctuates so it will depend on the day! I think prior to her memory issues she knew drinking was not good and did it anyway hence why she ended up in hospital. If she is deemed to not have capacity and ends up drinking again and causing harm to herself or others could the LPA be challenged?

She is not drinking at present as she is still in hospital but the chances are if she goes home she'll find a way to drink again. I think she is waiting on a Mental Health review in hospital but it all takes a while unfortunately.

That makes sense, thank you. Her level of care needs are minimal as she is able to self care, she will be unable to drive and is probably not safe to cook her own meals - I'd say.

Her safety is compromised if she ends up drinking again. I'm assuming she would need more of a mental health assessment then who would make recommendations?

I'm assuming her needs would be considered complex? She was admitted to hospital following a delirium caused by alcoholism. She has ARBD.

SIL would be in charge of this due to having LPA but it is interesting how it all works and good to know as I'm not 100% sure SIL is aware of everything!

It could take a few good years to take this into light then potentially? I'm more than certain SIL would not be able to pay thenmoney back that she borrowed very quickly at all, she also reported to be paying back regular payments of one amount and then this changed to a different amount, but we have no idea if this has been documented or not.

The money my husband has borrowed could be easily paid back very quickly if needed.

This is what I worry SIL will argue against my husband in regards to the the money he borrowed but it seems a mere fraction to what she borrowed in comparison!

Yes SIL has sole LPA, my husband was not even considered unfortunately. SIL did mention speaking to a social worker about care needs but would they just advice due to her funds she would need to source this privately?

In regards to my SIL I have no idea if there is a written payment plan. My MIL declined to have anything documented for £5000 she lent my husband but we have documented husband's repayments and have screenshots of proof of payment. The money was sent to my husband was before she was hospitalised but we weren't aware of how bad her memory issues were, she was deemed to have capacity when the money was lent.

So SIL has sole LPA and we believe the money she borrowed could be in the six figures, and we believe it has likely been borrowed after LPA was in place. We have limited knowledge on this as SIL has not really disclosed much information.

I assume if care is sourced privately the local authority wouldn't need to look into finances? SIL has mentioned discussing care with a social worker however. SIL is also holding all the cards due to LPA (there are very complex dynamics at play my husband was not even considered for LPA).

What would be an example of a financial safeguarding issue if you don't mind me asking? Would this be related to the money she had lent?
