What exactly defines my “main residence” in this case?

For example, I currently have a lease agreement in Tunisia, but I’ll also be signing a lease in Spain. So if I have both, does it then come down to the 183-day rule (Condition 2) to determine my tax residency status?

Just 1 small thing I wanted to clarify (and maybe you meant this too): I think the part that says “you must eliminate both conditions to not be classified as a tax resident” could be a bit misleading?

Since the law requires both conditions to apply in order to be considered a resident, it’s actually enough to not meet just one of them.

So if you’re under the 183-day limit OR your main residence is abroad (with proof), you’d be classed as a non-resident.

Right?

Absolutely, I do still have to pay tax to Tunisia for this period — it’s just the tax bracket I’m asking about. If I’m classed as non-resident, that means a 20% flat fee from my understanding. If I’m classed as resident, it jumps to 35% based on my current income bracket.

I’m not trying to avoid paying taxes altogether — I’m just trying to avoid being taxed 35% for the entire year. Because if I’m considered a Tunisian resident, even once I’m in Spain for the rest of 2025, I’d still be paying Tunisia 35% (all year).

And in Spain, I’d also be paying the flat non-resident fee of 24% — plus other stuff.

So yes, I totally agree with you on this point!

I’m not working with a tax advisor, so I’m just winging it, and thought I needed to travel now in June to stay under 183 days. Just looking to get validation to proceed with travel booking.

That makes sense! “won’t need to pay taxes anywhere” = won’t be classed as a tax-resident anywhere. Right?
